Traffic Violations
A speeding cruiser driven by a Worcester police officer who was responding to a non-emergency call almost hit the plaintiff as she crossed a street on foot. When the plaintiff cursed at the officer for almost hitting her, he turned around to confront her. When the plaintiff asked for his name so that she could file an internal affairs complaint against him, the officer arrested her for alleged disorderly conduct. We settled this case.
Sex Crimes
Miller v. City of Boston, 297 F.Supp.2d 361 (D. Mass. 2003) (permitting our client to proceed with a lawsuit against Boston police officers and the City of Boston based on his wrongful conviction for a rape he did not commit)
Robbery
Our client, a high school student, was arrested and charged with armed robbery. She was in the vicinity of the crime but was not involved in any criminal activity. The victim of the robbery told the police that our client was not involved and did not do anything, but the police arrested her anyway. The criminal charges were dismissed after the prosecutors spoke to the victim. This case settled.
Misdemeanors
In 2003, we represented a man who served three weeks in Dukes County House of Correction for a misdemeanor. One of the correctional officer’s girlfriends had worked at our client’s bakery, and believed she had not received all the money that was owed to her. Drug Crimes
In March 2007, we filed a civil rights class action alleging unconstitutional strip searches at the Franklin County Jail and House of Correction. Class representative Gregory Garvey alleged that 486 class members were illegally strip searched by corrections officers who had no reason to suspect they were in possession of drugs, weapons, or other contraband. The defendants were Franklin County Sheriff Frederick B. Macdonald and Special Sheriff Superintendent Forbes Byron, the people responsible for the policy. The class included people strip searched at Franklin County Jail after March 28, 2004, and before February 25, 2007. On October 22, 2009, the judge ruled that the strip search policy at the old jail was unconstitutional. The judge granted final approval to a settlement on January 14, 2011. On behalf of all defendants, the Commonwealth of Massachusetts agreed to pay more than $1.16 million to settle the case.
Assault
Against by being placed in the same cell as the inmate who assaulted our client. Predictably, the man who complained was also beaten. Dukes County Sheriff Michael A. McCormack condoned the actions of the correctional officers. Even though the officers were criminally prosecuted for conspiracy to commit assault and battery, one of the officers was re-hired to work at the jail while on probation. This case settled.
Murder

Shoplifting
We represented an Ethiopian immigrant who was criminally charged by store security with shoplifting a coat. He was charged despite the fact that he had a receipt showing he had purchased the coat at a different store. He was found not guilty at a criminal trial. The civil case settled.
Kidnapping
We represented Anthony Powell, a man who was wrongfully convicted and imprisoned for nearly twelve years. Despite his innocence, Mr. Powell was found guilty of aggravated rape, kidnapping, armed robbery, and assault and battery by means of a dangerous weapon. He was finally exonerated by the court on March 28, 2004, after DNA evidence proved indisputably that he could not have perpetrated any of these crimes. Mr. Powell alleges that the City of Boston failed to train its police officers properly and that members of the Boston Police Department used unduly suggestive identification procedures, withheld exculpatory evidence, and falsified forensic evidence. This case settled for an amount which is confidential.
