Guardianship
When guardianship is necessary and indicated, Peggy A. Pratscher can assist with all court filings and legal proceedings. In the Illinois Probate Act governing Guardians for Disabled Adults, the Act provides for the adjudication (determination) of disability, the appointment of a guardian of the person and/or estate, and court oversight of asset management and personal decisions.

Personal Injury
I graduated from John Marshall Law School in Chicago and was admitted to the Illinois Bar in 2002. Just prior to entering law school, I graduated Magna Cum Laude from Elmhurst College in 1999 with an undergraduate degree in Business Administration while continuing my long long career as a Registered Nurse since 1975. I began my legal career as an Associate in a plaintiff’s medical malpractice & personal injury firm in Chicago. However, my desire that derived from my many years as an RN providing case management, was to become a legal advocate for seniors and those with disabilities, so I pursued my goal to open a solo practice in Elder Law late in 2003. I enjoy the diversity of the many interrelated areas of law encompassed in an Elder Law practice and love working with each and every client to offer them opportunities to define and meet their life and estate goals and to help them work through their expected and unexpected life changes. The practice and life I strive to achieve, at work for and with my clients, and also at home with my family and friends, can be summed up by the words of wisdom from Winston Churchill, which greets my clients as they enter my office: “We Make A Living By What We Get, But We Make A Life By What We Give.”

Medicaid Planning
Medicaid Planning is a comprehensive and complicated process of evaluations of a client’s short and long term financial and health care needs to determine what each individual wants, needs and can or cannot afford. The rules for Medicaid Federally and in Illinois are complicated and sometimes open to interpretation by local caseworkers or which need higher level review. As with healthcare that is highly specific to each patient, each client situation is different and often leads to ambiguities in Medicaid laws and rules. Those persons who may not need to consider Medicaid because their finances appear adequate to support their needs for years to come, still need careful planning. Situations can change in a heartbeat, as some of us know firsthand and most people now in their late 80’s and 90’s never expected to live that long and yet they live on, often beyond their retirement savings. Medicaid Planning may come about naturally because someone outlives their savings or perhaps because their money was taken from them as early inheritance deemed to have been earned or surreptitiously without their knowledge.

Trusts and Estates

Estate Planning
Trusts are another estate planning tool that can manage assets before and after death. A trust transfers the management and administration of a person's property to some other individual or corporate institution, known as the trustee. The trustee is charged with the fiduciary duty to prudently manage and distribute the assets and/or income for the benefit of the beneficiaries of the trust. Some trusts can be established to manage assets during the life of the person creating the trust (called the “trustor” or “grantor” or “settler”) or they can be created as testamentary documents as part of one’s Will in which case they will not take effect or be funded until the person dies.
Wills
Peggy A. Pratscher carefully analyzes the individualized needs and objectives for each client to provide legal guidance. She is well versed in the changing needs for aging and disabled persons encompassing legal, estate and long term care planning. Planning for long term care may include different types of services that may include creation of durable legal instruments such as power of attorney, wills or trusts, and living wills; guardianships; and Medicaid eligibility and application processes.
Trusts
Special needs planning involves specialized knowledge to work with and ensure that disabled persons who have special needs are provided for. Peggy is knowledgeable and experienced in how to maintain continued eligibility for Medicaid and disability benefits while allowing supplements to be received from special needs trusts.
Power of Attorney
This is also an irrevocable trust that contains the assets owned by a person of any age who is disabled under the same criteria as a disability pay-back trust. This trust is created and managed by a nonprofit organization; a separate account is maintained for each person, but for management purposes of the trust the funds of all recipients are pooled together for investment purposes. An account is set up for the client's benefit by the client (or agent under power of attorney), parent, grandparent, legal guardian or a court. The state is paid back upon the death of the client, and any remainder may go to family.
