DUI/DWI
Infrared instruments are also known as "evidentiary breath testers" and generally produce court-admissible results. Other instruments, usually hand held in design, are known as "preliminary breath testers" (PBT), and their results, while valuable to an officer attempting to establish probable cause for a drunk driving arrest, are generally not admissible in court.
Sex Crimes
Under Oklahoma law a person who is a victim of domestic abuse, stalking, harassment or rape can petition the Court for a Protective Order, which contains specific orders designed to protect the person from further abuse. A household member may petition the Court on behalf of a minor. Typically the Protective Order will direct that the alleged perpetrator keep a certain distance away from the petitioner, and not attempt contact by any means including electronic communications or contact through third persons. The law governing Protective Orders is set forth at 22 Oklahoma Statutes §60.2. If the person seeking relief is a victim of stalking but is not a family or household member, or an individual who is or has been in a dating relationship with the defendant, the person seeking relief must file a complaint against the defendant with the proper law enforcement agency before filing a petition for a protective order with the district court.
Robbery
There are a variety of other theft charges under Oklahoma law, depending on the nature of the offense. There are several statutes pertaining to unauthorized credit card use or possession, theft involving trick or deception, theft involving placing items in pawn, etc. Robbery involves the threat of force or the actual use of force in connection with a theft.
Burglary
Larceny and theft are distinct from Burglary, which is committed when a person trespasses into a dwelling or other building with the intent to commit a crime. Burglary does not necessarily consist of the taking of property, although the intent to steal can upgrade a criminal charge from trespassing to burglary. Burglary is further divided into First Degree and Second Degree.

Misdemeanors
Under Oklahoma law, it is unlawful to operate a motor vehicle on the public roadways while under the influence of an intoxicating substance. The legal term is Driving under the Influence. It is also illegal to be under the influence in a vehicle which is parked if the person has the means to operate the vehicle, typically the keys, and the vehicle is operational, meaning that the vehicle does not have a mechanical issue rendering the vehicle unable to be driven. The legal term for this is Actual Physical Control. Under the law, Actual Physical Control is treated identically to Driving under the Influence. The methodology to determine intoxication, and the possible punishment are the same under each offense. In Oklahoma a first offense of Driving under the Influence is punishable as a misdemeanor with a punishment range of ten days to a year in jail, and a fine of up to $1,000. A second offense within ten years is punishable as a felony, with a possible punishment of one to five years in the custody of the Department of Corrections and a fine of up to $2,500. Offenses subsequent to a second offense have increasing possible terms of imprisonment.

Drug Crimes
U.S. Justice Bureau statistics show that Oklahoma has one of the highest overall incarceration rates in the country, and the highest incarceration rate for women. According to the Oklahoma Department of Corrections, in their 2015 Annual Report, 52% of Oklahoma’s prisoners were being held for non-violent offenses, and that of those, 26.3% were directly related to drug possession and distribution or manufacture. Of the remaining 22.7% of non-violent offenders, it is almost certain that the majority of those offenses were related to drug abuse, whether it be larceny and property crimes committed to obtain the money for purchasing drugs, or the irrational or dangerous actions that people sometimes take while under the influence of alcohol or drugs. The Federal Bureau of Prisons recently released statistics showing that over 50% of federal prisoners are being incarcerated for drug offenses. As a public policy matter, but also as a simple economic inevitability, the State and Federal systems must prioritize offenders by the degree that they endanger public safety, and to halt the warehousing of our citizens for crimes which are primarily a danger to the offender and not society as a whole.
Probation Violation
If the prosecution satisfies the judge that the probationer was in violation of the rules of probation. It is often not difficult for the government to show that a person is in violation. The main reason for this is that the burden of proof in a Revocation or Acceleration Hearing is lessened to a Preponderance of the Evidence. That means that for the judge to find that there was a probation violation, he must determine that the person “probably” did not follow one or more of the Rules and Conditions of Probation. This is in contrast to the burden of Beyond a Reasonable Doubt used in criminal trials, which would require affirmative proof of a probation violation to a moral certainty. As a result, it is often sufficient for the government to call one witness, typically the Probation Officer, to testify that a rule has not been followed.
