Criminal Defense

Misdemeanors
We handle a significant amount of DUI cases every year since our practice is focused on vehicle crimes. DUI defense requires a lot of technical expertise and experience. Our law office handles DUI -VC 23152 (a) driving while impaired and VC 23152 (b) driving with.08 or more and a lot of the related charges driving on suspended license, high blood alcohol enhancements, child endangerment, second, third and felony dui. On misdemeanor DUI's I appear in court on your behalf. Depending on the case we can retest blood evidence, have the prosecution's evidence (ie police report), reviewed by an expert forensic toxicologist, obtain MVARs, calibration records, dispatch tapes, interview witnesses with an investigator try and obtain a helmandollar or plea down to lesser charges. We will also do motion work, motion to suppress and jury trials if necessary.
Probation Violation
DUI Defense primarily in San Joaquin County, Sacramento, Placer and Yolo. 1st DUI VC 23152 (a), VC 23152 (b), Second DUIs, Third DUIs, Felony DUIs, Wet and Reckless, DUI Probation Violations, DUI expungements, and related DUI charges.
Hit and Run
Our law office typically represents commercial and professional drivers and those drivers who are close to the negligent point suspension. We also represent many drivers who are charged with misdemeanor crimes such as hit and run, driving on a suspended license, reckless driving and driving without a valid license. However, we are happy to represent all drivers who wish to retain legal counsel to assist them with the court process in defense of their infraction traffic citation to try and keep their DMV record clean or car insurance rates down.

Personal Injury
David Barzaga worked for Samuel & Samuel, a civil litigation/class action/personal injury law firm in Fair Oaks, California in 2004. He later moved to Choyce Crowell, LLP a personal injury/criminal defense law firm specializing in DUI and traffic cases in downtown Sacramento.

Wills
We strongly feel everyone needs an estate plan even if it is a simple will nominating guardians for minor children, selecting your executor and beneficiaries for a small estate or a transfer on death deed or of course a revocable living trusts that is funded with trust assets and avoids probate. We can quickly prepare advance health care directives and HIPAA forms before a scheduled hospital surgery visit or when your children turn 18 and go off to college. Over the years we have developed the skills and knowledge to be a really effective estate planning attorney. I started doing wills and trusts 10 years ago but the product itself has improved. Now in 2017 we provide nice elegant planning binders organized with tabs, numerous documents, summaries, instructions, informations, and cover artwork. We can explain to you each and every part of your estate planning documents we prepare for you.
Trusts
Reason #3. We consider trust administration an easier and faster process than probate to deal with real property and other assets. The trust already owns the real property if the living trust is properly funded and the distribution process often takes less time unless you delay the distributions in the trust (i.e parents giving their children the inheritance in stages. Please note this will incur additional trust administration costs)

If you have a stroke, aggressive cancer, coma or serious medical illness where you lose capacity our estate planning documents can help you during your life time if you have a trust worthy person in your life. It takes time (days or weeks) to prepare and file a conservatorship and in some cases you will need someone with legal power to make a medical decision quickly. (Advance Health Care Directive – Agent can make medical decision on your behalf legally. Power of Attorney – Agent can access your bank accounts and pay your medical bills and regular bills while you are in the hospital.). If you don’t have these documents someone will to go court and petition to be your conservator in a conservatorship proceeding.
