Child Support
Emancipation is a concept that releases a child from both the control and support of apparent. Despite popular belief, emancipation does not automatically occur when a child turns 18. The law on emancipation in New Jersey is by statute that was enacted on February 1, 2017, and applies to all Child Support Orders.
Child Custody and Visitation
It used to be the law that a Court in making its decision must first determine whether the custodial parent has a good-faith reason to move with the children. Any sincere, good-faith reasonÂ sufficed such as moving to live near relatives, seeking new or higher paying employment, or the custodial parent’s remarriage satisfied the good-faith requirement. After Courts found that the custodial parent wanted to move for a good-faith reason, it then considered whether the move will be in the best interest of the children or whether the relocation will adversely affect the visitation rights of the non-custodial parent.

When calculating child support, you can estimate the amount of support a judge might order by determining the total income available for support from both parents and then completing either the Sole Parenting Worksheet (Appendix IX C) or the Shared Parenting Worksheet (Appendix IX D). Courts require these worksheets in all cases where a parent seeks to establish or modify (change) child support if you fit into the combined gross income threshold. The New Jersey Department of Human Services is the state agency responsible for helping parents obtain and enforce child support orders, including locating absent parents and establishing paternity, if necessary.
