Overall

In June 2013, I completed a year-long process that included walking my house almost daily, watching the construction of my home, dealing with the financial aspects, and the father/daughter dynamics of Termeer and Associates aka Termeer Custom Homes aka Termeer Design Group. I also spent 3-1/2 months since moving into my home waiting for subs to show up to complete the punch list---often, they did not, or they would show up with zero notice.

Regarding Termeer's financial stability: I would advise anyone who considers hiring Termeer to conduct a public records search of the man and his company before entering into a contract with him. Go here: https://gov.propertyinfo.com/tx-montgomery/ and register to use Montgomery County's online records search. It's free. Once you have registered, log on and do a name search for John J Termeer and also Termeer and Associates. THIS IS PUBLIC INFORMATION! Pay close attention to any liens, abstract of judgments, and a Dec. 2012 reverse mortgage associated with Termeer and/or his company.

Ask for Termeer's resume. If he gives it to you, check everything for accuracy. Verify all claims of prior employment. Ask if he has left any other past employment off of his resume. For example, ask him about his association with International Body Shop in the early 1980's. Ask John Termeer about his position as manager of Tk Group, LLC, which according to the TX Secretary of State was licensed Oct. 4, 2013. Verify any college degrees he claims to have received by paying a small fee and using the National Student Clearinghouse's degree verify services online. http://www.studentclearinghouse.org/colleges/degreeverify/ Try to google search and call all the professional societies (if he has listed them on his resume and/or LinkedIn), and verify he was/is a member---particularly the American Society of Civil Engineers.

Ask Termeer about his website www.termeer.com and the homes that are listed today (2/14/14) as "available." Zillow.com shows that 10 Glensheen Way was built in 2006 and is not available for sale. It shows 27 N Fazio Way was built in 2007 and is not available for sale. Some months back, I walked through 27 N Fazio and met the owner. Also what about the two other men in the photo under "meet the builder" at Termeer's website. Ask Termeer who they are and do they still work for/with him. Ask him why information on his website appears to be incorrect (outdated) in 2014. Ask Termeer couldn't his website be viewed by some in 2014 as "deceptive practices to obtain business?" Then ask him exactly how many people (not subs---people on the Termeer payroll) work for him, and who walks the property daily during construction. Ask to meet that person BEFORE signing the contract. Ask Termeer if anyone has sued him or his company in the past. Ask him if anyone is currently suing him---and if so, why? Ask if he has sued anyone, and if so, why? Ask him: What was the outcome of any/all lawsuits?

And lastly, if Termeer's contract is a Greater Houston Builders Association contract, MAKE SURE Termeer attaches "Exhibit H" (Disclosure Statement for a Residential Construction Project), which states: "Texas law requires your contractor to provide you with this brief overview of some of your rights, responsibilities, and risks in this transaction. Know your contractor"..."make sure you have investigated your contractor." Under "Monitor Payments," "Exhibit H reads": "Your contractor is also required to furnish you with a statement at least once each month of money disbursed to subcontractors and suppliers for this project. Review these statements and make sure that the money is being properly disbursed." Then ask Termeer, "Will you be furnishing me with a statement once a month of money disbursed to subcontractors and suppliers for my project?"

Would I recommend John Termeer, Termeer Custom Homes, Termeer Design Group aka Termeer and Associates? No!
