Is my employer violating my legal or civil rights under current employment law? What is wrongful termination? I need to terminate an underperforming employee, but, in today’s litigious society, I am afraid of being sued. How do I protect my company?
Employment Discrimination
If you are an employee or an employer with questions about employment discrimination or other legal matters, please call to schedule an appointment with an attorney without delay to discuss your legal rights and the remedies available to you.
Jennifer Hilburn joined the firm in 1998 after resigning from her post with the Regional Solicitor of the United States Department of Labor in Dallas, Texas after four years of dedicated service as a trial attorney safeguarding employee rights and enforcing federal employment laws related to the Occupational Safety and Health Act (OSHA); Fair Labor Standards Act (FLSA), including minimum wage and overtime laws; Family Medical Leave Act (FMLA); Pregnancy Discrimination Act (PDA); and other federal statutes. Jennifer has taken her experience as an insider and now efficiently and effectively represents employers, as well as employees, in administrative claims, and other defensive matters that arise out of alleged violations of state and federal employment regulations and statutes. Jennifer has also built a significant practice counseling and advising clients in wrongful termination claims based on statute, private contract or union collective bargaining agreements. She also assists in negotiating executive compensation and benefits severance packages; drafting, prosecuting and defending non-competition, non-solicitation and other restrictive covenants used in employment contracts and handles a variety of other claims related to labor and employment law in addition to maintaining an active interest in personal injury, business and civil litigation handled by the firm.
Disability Discrimination
While some say this decision further limits the range of conditions afforded disability status protection under the ADA, others believe this decision opens the door of ADA protection to those individuals suffering from conditions not traditionally considered disabilities but that nonetheless substantially limit the individual’s ability to perform major life activities as compared to the general population. Whether you are an employer or an employee, the Toyota decision seems to follow the trend of recent decisions redirecting the focus of protections under the ADA to a limited number of individuals with real disabilities as was the intent of Congress in enacting The Americans with Disabilities Act in 1990. The primary question in determining the merit of disability discrimination cases will continue to be whether the individual’s condition substantially limits the individual’s ability to perform those activities central to everyday life and will require analysis on a case-by-case basis.
Employment law, business law, wills and probate/successions. We also practice with experience in other areas. In 2001, after seven years of practice, Jennifer as a trial attorney with the U.S. Department of Labor and Cary in private practice, we left Dallas, Texas to make Shreveport our home. We continue to work with clients throughout Texas, Louisiana and Colorado and across the country and split time between Shreveport, Louisiana and Durango, Colorado.
