Nussbaum Richard MD

1. Dr. Richard E. Nussbaum (surgeon) of the "Los Angeles Orthopaedic Institute" has worked through this private practice, helping thousands of injured people for years.

I consider this career choice very admirable.

2. Dr. Nussbaum also applied to, and was appointed as a Qualified Medical Evaluator by the Dept. of Industrial Relations -Medical Unit - for the State of California, as an (presumably unbiased) examiner who evaluates and writes medical status determinations) regarding legally unrepresented injured workers, on behalf of the Calif. Department of Workers' Compensation, and the "Workers' Compensation Appeals Board" (W.C.A.B.).

Again, I consider this service (though compensated) as just, and also most admirable.



The key problem is not that Dr. Richard E. Nussbaum has a practice (as the L.A. Orthopaedic Institute) or that he performs presumably unbiased exams & reports of legally unrepresented injured workers as a “Qualified Medical Evaluator” for the benefit of Workers' Comp. Appeals Board Referees’ or administrative judges’.

No, these two very admirable endeavors are not the problem.



3. The problem is that Richard E. Nussbaum, M.D. also (for years and to this day) has, and continues to earn up to $8,000. per trial day, as an “Expert Medical Witness” representing numerous major insurance companies against presumably injured persons in personal injury (defense) jury trials.



The brutal fact is that the sole intent of insurance carrier attorneys, insurance company investigators, insurance company claims adjusters, and insurance company expert medical witnesses, such as Dr. Nussbaum (and to be truthful, plaintiff attorneys as well, but take only “slam dunk’ cases) is simply to discredit the plaintiff, by any tactic necessary (honorably or otherwise) in hope that the jury will arrive at what is called a ‘defense verdict”, (no award to the plaintiff) or at least a significantly reduce the jury’s award to the claimed injured person.

This saves all insurance companies billions and billions of dollars, and for those who assist in these savings, there is continued work, and financial bonuses awaiting them all.



When employed by these insurance companies, the millions and millions of dollars with his “Expert Medical Witness” (for the defense) testimony.

This obvious conflict (affecting millions of American’s) has resulted as the unspoken secret of those “law-makers”, and legislator’s, local, state, and congressional, (owned by donations from the Insurance Company Lobby) are bound by campaign contributions to ignore those desperately in need, increasing the profits of all insurance companies.



It was discovered some eighteen months after Dr. Nussbaum’s examination/report of me, was found to be a misdiagnosis by neurosurgeons at L.A. County + USC Medical Center, as the result of a CT scan which revealed dual fractures of the pars interarticularis (which should have been ordered following Dr. Nussbaum’s exam and review of his own X-Rays. Dr. Nussbaum, being the first physician ever to discover the malady of “Spondylolisthesis” (the immediate 25% misalignment of my L4-L5 vertebra from well documented date of injury) which even Dr. Nussbaum stated to me “was not present in a lumbar MRI” eleven months earlier.

The delay of treatment (two years from injury date) has resulted in bilateral collapsing legs, a paralyzed right foot, and unimaginable financial devastation to our family of five.

I welcome all defamation law suites from Dr. Nussbaum and Zurich North American Ins.
