Criminal Defense
San Antonio is a very large metropolitan area encompassing eight counties including Bexar, of which San Antonio is the county seat. Most lawyers who practice law in San Antonio must be prepared to represent people in all of these counties, and they must be able to try jury trials. However the jurors in any trial, regardless of the county of your residence, must be selected from persons who reside in the county in which the offense is filed. In criminal law it is imperative to know the nature of the jury pool from which the jury will be drawn in your case. The jury verdicts and sentences in similar cases to yours will be reflected in the attitudes and behaviors of the judges and prosecutors in the county in which you are charged because these public officials are elected by the citizens who sit on the juries. Your lawyer must be familiar with these dynamics, or serious mistakes could be made in the course of plea bargaining and motion practice as well as in the course of a trial.
DUI/DWI

Traffic Violations
Did the police officer have reasonable suspicion to pull the car over ? A police officer canâ€™t randomly pull drivers over (unless itâ€™s at a designated sobriety checkpoint). They need a reason. Leaving a drinking establishment at a late hour is a possible reason, as is any traffic violation, however minor. But there has to be something that a reasonable person would consider valid for pulling a driver over.
Misdemeanors
In the misdemeanor courts some judges are more forgiving than others, but some have no tolerance for violations. In the felony courts there is no tolerance. Bond violations most often result in doubling of bond and a warrant of arrest. Ask your lawyer about your judge.

Murder
Until 1990 I was engaged in the general practice of criminal law. I have practiced in state and federal courts in Texas, Louisiana, and Tennessee. I have filed dozens of appeals in most of the appellate courts of Texas. I have been licensed in and have appeared before the United States Court of Appeals for the Fifth Circuit, United States Court of Appeals for the Eleventh Circuit, and the United States Supreme Court. I appeared before the United States Supreme Court on March 1, 1988. I appeared in an en banc argument before the United States Court of Appeals for the Fifth Circuit in 1998. I have tried capital murder cases in state court. I have tried many different types of cases in federal courts, including a five-week federal bank fraud case that ended in a not guilty verdict for my client. I have tried many jury trials in Bexar and the surrounding counties.
Probation Violation
There are cases where probation violations can be misunderstandings. An example might be with the use of the ignition interlock device. The same issues that can give off a false positive on a breath test on a traffic stop can apply with ignition interlock. But in the latter case, the false positive will automatically be reported to the probation officer. Before probation can be formally revoked, there has to be a hearing, and an experienced lawyer can work with defendants to expose any misunderstandings.

Most of my trials have been before the District Judges and juries involving things like bank fraud, large drug conspiracies, extortion and gang activity. I have handled one federal death penalty case. While DWI is on the low end of the criminal law spectrum in the federal system it is, nevertheless, very intimidating. Therefore, I treat these cases as seriously as I would treat these very serious felony matters because I understand how difficult it is for my clients.

Property Damage or Injury: If the DWI offense resulted in property damage or injury to another person, it could result in more severe penalties.
