Child Custody and Visitation
The California Penal Code defines felony Domestic Violence as a person willfully inflicting corporal injury, resulting in a traumatic condition, on a spouse, former spouse, cohabitant, former cohabitant, or mother or father of his or her child. Misdemeanor Domestic Violence is defined as a battery on the same individuals. When the police arrive at a call regarding a domestic violence dispute, they have a duty to investigate and make an arrest, even if they only get one side of the story. Since these cases often involve husbands and wives, boyfriends and girlfriends, same-sex couples, or domestic partners, there is a lot more history to the dispute than a typical disagreement. Feelings and emotion are involved and the cases usually include issues that both people have with each other. It is important to have an experienced attorney to help explain your side of the story to both the District Attorney's Office and the Judge handling your matter. Domestic Violence cases often carry important collateral consequences and can affect child custody issues, divorce or separation proceedings, the ability to own a firearm, and often result in restraining orders. DUI/DWI
In the court system, California Vehicle Code sections 23152 and 23153 govern DUI laws. The law states that you can be found guilty for driving under the influence of alcohol and/or drugs, if such alcohol and/or drugs impairs your ability to drive like a sober person, or if your blood alcohol content is 0.08% or above. There are enhanced penalties if your blood alcohol content is above 0.15%. If someone is injured as a result of your DUI arrest, the case can be a felony with additional, significant consequences.
Sex Crimes
Some examples of sexually-related crimes consist of rape, statutory rape, unlawful touching of a minor, forced sexual acts, possession of child pornography, indecent exposure, inappropriate touching, human trafficking, and pimping and pandering. These crimes carry extremely serious penalties, including life in prison, depending on the crime. In addition to prison sentences, many sex-related crimes carry lifetime sex registration, pursuant to Penal Code 290. This sex registration requirement will permanently affect your residency as there are many prohibitions on where a sex registrant can live. Most police departments have big budgets and specially trained officers who handle sex related crimes. These officers work hand in hand with the district attorney when investigating and prosecuting cases.
Robbery
Penal Code 211 and 212.5(c) define robbery as the felonious taking of personal property in the possession of another, from his/her person or immediate presence, and against his/her will, by means of force or fear. It is a felony and depending on the degree of robbery, can be punished in state prison for up to five or six years. If the person had a weapon, then there can be significant additional penalties, up to an additional 10 years, 20 years, or life penalty. In addition, robbery is considered a “strike” under the Three Strikes Law. That means that it will have future consequences if you are convicted of a felony in the future.
Burglary
In California, certain serious felonies are referred to as "strikes". If you are charged with an offense that can be a "strike," it is imperative you have an experienced criminal defense attorney from Jackson Law working for you. Conviction of a strike offense will have lifetime consequences; with increased severity if you should you get convicted of a subsequent felony offense. Examples of felonies that are "strikes" include murder, rape and most felony sex crimes, inflicting great bodily injury on someone, attempted murder, robbery, assault with the intent to commit robbery, assault with a deadly weapon on a police officer, arson, kidnapping, first degree burglary, using a deadly weapon during a felony, carjacking, grand theft with a firearm, gang offenses and assault with a deadly weapon.

NOTE: This section does not apply to violations of Penal Code 286(c), 288, 288a(c), 288.5, 289(j), 311.1, 311.2, 311.3, 311.11, or felony convictions for Penal Code 261.5 It is discretionary as to misdemeanors falling under Vehicle Code 42002.1 (dealing with convictions for Vehicle Code 2800 et all affecting one’s driver’s license privilege).
Embezzlement
In California, there are numerous theft crimes with which a person can be charged, such as robbery, embezzlement, petty theft, and grand theft. In many theft cases, the State must prove the defendant’s intent. Therefore, if you can show that you did not knowingly take the property or intend to deprive the rightful owner of the property, you may be able to convince a jury that you are not guilty. Alternatively, if you can establish that the owner of the property consented to your taking the property, you should be able to avoid a conviction. Drug Crimes
Under the California Uniform Controlled Substances Act, controlled dangerous substances are classified into schedules, with Schedule 1 drugs, such as heroin and other opiates, being the most dangerous. You can be charged with a drug crime if you possess a controlled dangerous substance for which you do not have a prescription, regardless of whether or not you intend to sell the drug. You can also be charged with a crime for selling or manufacturing drugs. The severity of the charge will depend on both the type and the quantity of the drug that you are charged with possessing, selling, or manufacturing. There may be numerous defenses available to drug charges, including entrapment and illegal searches and seizures. In some cases, a defendant may be eligible to attend a pre-trial diversion program as an alternative to jail time. Sex Crimes
Assault
In California, there are several charges of Assault and Battery that can be felonies or misdemeanors. Generally, an assault is an unlawful attempt to commit a violent injury against another person. A battery is a willful and unlawful use of force or violence against another person. The crimes of Assault and Battery are included in the California Penal Code in sections 245, 243, 242 and 240. If these charges allege use of a weapon or cause great bodily injury, you can be charged with a violation of Penal Code section 245, which can be a "strike" offense.
