Paul Davis was raised in Greensboro and now resides in Cary. He has been in private practice continuously since 1984. He brings a deep understanding of academic construction law to his contract disputes practice. He has studied and briefed virtually every aspect of construction contract law and concentrates his practice in the areas of construction arbitration and litigation and contract drafting and negotiation for public and private clients, including general contractors, construction managers, and subcontractors. He regularly drafts EPC agreements and energy service agreements, particularly for the solar energy industry. Mr. Davis also represents clients in occupational licensing matters.
Construction Contracts
Construction law is fundamentally contract law. Knowledge of statutes and court rules is critical on construction projects, but the scope of a project, the payments to be made for labor, materials and services, and the allocation of risks and responsibilities among the project participants are primarily determined by contracts and related attachments and administrative documents. Our services include review, drafting and negotiation of design contracts, construction contracts, supply contracts, equipment leases, loan agreements, security agreements, disposal contracts, consulting agreements, bonds and surety indemnity agreements, takeover agreements, and project-specific and manuscript insurance policies. For the majority of his career, Holt’s practice concentrated in construction, environmental, and employment disputes, and business activities for private industry clients. Holt co-authored numerous books and was the author of more than twenty-five articles on construction and environmental topics. From 2007-2015, he was Editor-in-Chief of the semiannual Journal of the American College of Construction Lawyers. He lectured frequently to bar association and industry groups.

C. Hamilton “Hank” Jarrett is a native of Charlotte, North Carolina, and has lived in Raleigh since 1991. He has been in private law practice continuously since graduation from law school in 1983. Before attending law school, he obtained a Bachelor of Science degree in Civil Engineering, and was employed in the practice of Civil Engineering with extensive involvement in public works projects, including solid waste and wastewater management, utility line and highway construction, and planning and zoning administration. His law practice concentrates on government and construction contract and surety law, as well as bankruptcy law relating to the construction industry. Hank is a certified Superior Court Mediator in North Carolina.

Foreclosure
Equipment lease default: Successfully collected a debt owed to a commercial equipment leasing company after the lessee defaulted. Collection required foreclosure on both the equipment and the underlying ground lease, allowing the debtor’s business to be sold as a going concern to pay the debt.
