Personal InjuryThe question most people have on their minds when they get into an accident is “Who is going to pay for all of this”? Although the question is short and simple, the answer is long and complicated. This article will explain one small aspect of this issue. This article will explain only what happens when a pedestrian is struck by a vehicle while riding a bicycle. Florida is known as a “no fault” state. What this means is that no matter who is at fault in an accident, if you are in an automobile accident, the victim must first use their own car insurance to cover 80% of all medical bills under $10,000 ($2,500 if there is no medical emergency medical condition). This is known as Personal Injury Protection coverage (a.k.a. PIP) So if a pedestrian is struck on a bicycle by a car, the pedestrian must use his or her own car insurance to pay for any medical bills under the PIP limits as long as medical care is sought within 14 days of the accident. If medical care is sought after 14 days of the accident then the pedestrian’s PIP insurance would not apply and the defendant’s insurance company (if the defendant is found to be at fault) would pay for the medical bills up to the policy limits of the defendants insurance company. Let’s see two examples...
Medical MalpracticeSpecific types of cases that our injury attorneys handle are auto accidents, trucking accidents, motorcycle accidents, wrongful death, slip & fall injuries, defective & dangerous (recalled) products, nursing home neglect or abuse, construction site accidents, cruise ship accidents, dog bites and medical malpractice.
Property DamageTo date, approximately four deaths and at least 139 injuries have been tied to the defective airbags. One can expect that others may have been injured by these defective airbags but may not have recognized the cause of the injuries at the time. Being involved in an accident is sometimes an extremely confusing and stress-inducing situation. Depending on the level of property damage to the vehicle, it may be difficult for the average person to determine whether a particular type of debris came from shattering glass, plastic dashboard components or a dangerously explosive airbag. An expert in the field of automotive safely would best be able to determine the cause.
Employment LitigationOur Litigation & Trial division handles cases dealing with injuries, insurance claim denials, employment disputes, and large commercial business disputes.
Business and Corporate Law
Hit and RunIf you carry collision coverage, your own insurance company will pay for your car repair or total loss, subject to your deductible. If you are injured, your PIP coverage will cover most of your medical bills and if you carry Uninsured Motorist Coverage, you can be compensated for your injuries, pain, suffering and out of pocket expenses not covered by your PIP coverage. A “hit and run” accident is one of many examples where carrying Uninsured Motorist Coverage is essential to protect yourself and your family.
Criminal DefenseThe Criminal Defense Division of our firm has been representing individuals charged with major crimes in state and Federal courts throughout Florida since 1979. The Criminal Defense Division was formed by attorney Dennis Schaefer following the completion of his term as a Broward County Assistant State Attorney.
Wrongful DeathOur client, a 52 year-old husband and father of 2 minor children, lost his life when a commercial truck caused his vehicle to leave the highway and rollover into a canal. On behalf of the surviving wife and 2 minor children, we filed a wrongful death action against the owner and driver of the commercial truck.
Traffic ViolationsOur client was a husband and father of two minor boys when he died in an automobile accident as the result of the negligence of a commercial truck driver. The trucking company claimed that the decedent failed to use due care and was speeding. Prior to filing a lawsuit we were able to obtain the maximum policy limits of $1,000,000 for our client's family.
