He has handled scores of writs of mandates, administrative hearings, and litigation involving planning matters, police and disciplinary proceedings, problem bars and liquor stores, massage parlors, and other nuisance businesses, environmental matters, Brown Act violations, intergovernmental disputes, election disputes, and public works contract disputes. He has testified before the California Legislature on the subject of massage regulation. Mr. Burns has been a presenter for the League of California Cities on CUP revocation.

We have defended cities in numerous employment and labor disputes and served as advisor to the hearing officer in scores of administrative hearings.

Examples of our Firm’s successful court record include obtaining an abatement order shutting down a drug house, successfully defending writs of mandate (over 30) including employee terminations, massage parlor closures, bar nuisance closures, defense of M.O.U. provisions, disputes between government agencies, successful CEQA litigation, successful resolution of Brown Act and Subdivision Map Act lawsuits, defense of conspiracy and tort claims, successful defense of claims of employment discrimination and harassment, defense of peace officers in civil trials, and innumerable public nuisance, receiver, and code enforcement matters.
Employment Litigation
Our lawyers include a former supervisor for the Southern California office of Cooperative Personnel Services, who conducted labor relations workshops nationwide though the Public Employment Relations Division of the Department of Labor and was responsible for labor relations in the Corona-Norco Unified School District. We have handled hundreds of administrative proceedings involving employee discipline and contract grievance as well as litigation of employment issues in civil actions and writ proceedings. We have successfully represented public agencies in unemployment insurance actions.

In the course of his thirty-seven years of practice, Mr. Harper has represented exclusively public agencies in all areas of municipal law, as a city attorney, general counsel and special counsel in municipal finance and litigation, principally the areas of land use and planning, environmental law, risk management, real property and eminent domain.
Land Use and Zoning
We regularly attend Planning Commission meetings and advise planners and Commissioners on land use law and administrative procedure. We have prepared all types of entitlement documents including conditional use permits, land use indemnification agreements, development agreements, and ensure that approvals have a defensible administrative record and findings.
