Wrongful Death
A wrongful death claim is a suit that arises from the death of an individual that was caused by the conduct of another. A wrongful death suit is different from other types of personal injury claims because the actual victim (the "decedent") is not bringing suit, rather it is the family members or the decedent's estate. Sex Crimes
There are secondary consequences to a conviction for a sex crime. The court can require registration as a sex offender for the rest of your life. Registration can destroy opportunities for future employment and the ability to live peacefully in a community. In addition, a conviction for a serious sexual offense can lead to a life-time involuntary civil commitment even after the penalty for the criminal conviction is finished. If considered a "sexually dangerous" person, a person can be committed in a treatment facility indefinitely. Our office has litigated numerous "sex predator" prosecutions. Attorney LeBell has trained lawyers and mental health professionals in this subject during presentations in many states and Canada.
Misdemeanors
If you are a first time offender and the offense involves possession of a very small amount of controlled substance, the State will usually charge the offense as a misdemeanor. Penalties may include a fine, jail, or a term of probation. If you are a second time offender of any drug offense, a first time offender involved in possession of a controlled substance that is more than normal for personal use, or are involved in any type of delivery of a controlled substance, the State will generally charge it as a felony. If the offense involves large amounts of methamphetamine, cocaine, ecstasy, heroin or marijuana, the police may refer the matter to the Federal Government for prosecution.
Drug Crimes
There are many defenses to drug charges. They include challenges to police conduct, such as: illegal searches, forced confessions, wrongful traffic stops, and unlawful wire taps. We routinely conduct exhaustive investigations of government informants, cooperating co-defendants, and police officers whose credibility may be questionable. Motions may be filed which challenge any wrongful conduct by the police or prosecutor. We may also argue that the amount of drugs is more consistent with simple possession than with distribution or sale.

Estate taxes continue to be a concern. Federal tax law has increased exemptions so that fewer estates are subject to estate tax. However, the current tax climate is uncertain. The current tax law is effective through 2010, and no one is sure how the tax laws will change at that time. Also, families who believe they have a modest estate may not consider how their estates has grown, and what property the tax authorities consider. In addition to real estate and investments, federal and state tax laws consider life insurance, retirement assets and other property when determining a "taxable" estate. A fairly straightforward estate plan with bypass trusts can effectively double the value of property passing to the next generation free of estate tax.
