The Tax Court held that the IRS properly disallowed a charitable contribution deduction claimed by a partnership for donating a conservation easement over a tract of land. The court found that the appraisal on which the charitable contribution deduction was based was not a "qualified appraisal" as required by Code Sec. 170(f)(11)(D) because the partnership and the appraisers made an agreement concerning the amount at which the property would be valued and the partnership knew that such amount exceeded the fair market value of the property. Form 1065
The IRS provided penalty relief to partnerships that fail to furnish Part IV of Form 8308, Report of a Sale or Exchange of Certain Partnership Interests, to the parties to a sale or exchange of an interest in the partnership that occurred during calendar year 2023, in which any money or other property received by a transferor is attributable to unrealized receivables or inventory items (Code Sec. 751 property), by January 31, 2024. The IRS will not impose penalties under Code Sec. 6722 if the partnership timely furnishes Parts I-III of Form 8308 and furnishes a complete copy of Form 8308, including Part IV, to the transferor and transferee by the later of (1) the due date of the partnership's Form 1065 or (2) 30 days after the partnership is notified of the Code Sec. 751 exchange. Notice 2024-19.
Income Tax
The Tax Court held that a taxpayer was not entitled to equitable relief from joint and several liability under Code Sec. 6015(f) because she significantly benefited from the underpayments of income tax underlying the case. The court found that the unpaid tax liabilities were at least partly attributable to early retirement distributions that were used to make mortgage payments on properties the taxpayer continued to own and that the taxpayer continued spending for a lavish lifestyle despite knowing about the unpaid liabilities. Thomas v. Comm'r, 162 T.C. No. 2 (2024).

Accounting Services
Taylor hired Gard to manage Taylor and Co.'s bookkeeping and other accounting matters. Over a period of years Gard embezzled between one and two million dollars from the company. The embezzlement scheme was discovered in August 2013. Gard suffered a heart attack during a meeting with Taylor while they were going over records that Gard apparently had fabricated to cover up his embezzlement. According to Taylor, he took actions that saved Gard's life; and while recovering at the hospital, Gard confessed to the embezzlement. Taylor hired attorneys and accountants to reconstruct the amount of the losses Taylor and the company sustained because of Gard's embezzlement. Later Taylor and the company sued Gard to recover those losses.

Annuities
If a taxpayer did not receive Form W-2 or a Form 1099-R, Distributions From Pensions, Annuities, Retirement or Profit-Sharing Plans, IRAs, Insurance Contracts, etc., by early February, or if the information on the form that was received is incorrect, a taxpayer should take the actions outlined below.
Charitable Remainder Trusts
On March 22, the IRS issued proposed regulations that identify the charitable remainder trust transactions described in Prop. Reg. Sec. 1.6011-15(b), and substantially similar transactions, as listed transactions for purposes of Reg. Sec.1.6011-4(b)(2) and Code Secs. 6111 and 6112. In addition, they inform taxpayers that participate in these transactions, and persons who act as material advisors with respect to these transactions, that they would need to disclose the transaction in accordance with the final regulations and the regulations issued under Code Secs. 6011 and 6111. Material advisors must also maintain lists as required by Code Sec. 6112.
