Adoption
North Carolina adoption law, in a nutshell, allows persons over the age of 18 to become a parent of another person (except a spouse). After an adoption is finalized, an adopted child has the same rights and privileges as a biological child. Adoptive parents are responsible for providing for the child, and also have legal parental rights.
Paternity
Today, people build families in all kinds of ways. Itâ€™s not uncommon to have children outside of marriage. But when they do, itâ€™s paramount that both parents have a role in supporting their childâ€™s well being, both financially and emotionally. Sometimes one parent may be uncooperative and the legal system may have to intervene, in both legitimation and establishing paternity.
Premarital Agreement
Premarital agreements (sometimes called prenuptials) are documents designed to set up in advance how property and assets will be divided in the event a marriage ends in divorce. A postmarital agreement (or postnuptial) is generally the same thing, with the exception that itâ€™s drafted and signed after the couple is married.
Guardianship
Additionally, the UDPCVA allows parents to place a special and temporary agreement with the court while a military parent is deployed. This agreement must be written and signed by both parents and filed with the court with the understanding that it expires when the deployed parent returns. The temporary agreement can assign caretaking or guardianship to a noncustodial parent (or nonparent) when one or both custodial parents are deployed. The parent can also agree to specific times and means of electronic communication between the child and the deployed parent.
Spousal Support
Each state has its own laws regarding spousal support, also known as alimony. As military courts donâ€™t handle divorce proceedings, spousal support during a divorce is determined by North Carolina G.S. Chapter 50. Military service doesnâ€™t exempt an individual from spousal support, but it doesnâ€™t entitle an individual to spousal support either. The courts look at factors like each spouseâ€™s earning capacity, length of the marriage, age and other considerations when determining appropriate alimony awards.
Child Abuse
However, if you or the other parent is filing for child custody or visitation, youâ€™re required to go through theÂ North Carolina Child Custody and Visitation Mediation Program. In certain cases, the court may forgo mediation when â€œgood causeâ€ exists â€“ including domestic violence, child abuse or neglect, and substance abuse. If you canâ€™t find resolution through mediation, your case will move to court for a judge to decide.

Kidnapping
If neither parent has a formal and court-ordered child custody plan in place, many different issues can arise if one decides to move out of North Carolina. One of the parents could view it as a problem and refuse to comply, or â€“ in extreme cases â€“ even view the situation as a kidnapping. However, without a court order in place (and unless the relocating parentâ€™s goal is to evade the law), a parent can technically and legally move with their child.

Wills and revocable trusts. In North Carolina, a separation has no effect on your will or trust. If the death of one spouse happens before the divorce, the other spouse will inherit whatever is outlined in the will. An irrevocable trust, however, many remain valid, as itâ€™s similar to a contract.

Consider having your lawyers update retirement and life insurance beneficiaries, revoke and replace your power of attorney, and update your living will.
Probate

Bankruptcy
If you are already in the middle of your Charlotte divorce and either you or your spouse file for bankruptcy, your divorce can proceed, but the automatic stay may slow down the process considerably. As we discussed earlier, during a bankruptcy, all property and assets of the debtor becomes the property of the bankruptcy estate. There are some property exemptions under North Carolina bankruptcy law, including things like motor vehicles, college savings accounts and homestead/residence.
