Premarital Agreement
Premarital or antenuptial agreements are agreements between prospective spouses made in contemplation of marriage and intended to be effective upon marriage. Post marital agreements are agreements made after marriage. Premarital agreements and post marital agreements are valid and binding agreements and are subject to the same rules. They are designed and intended as a roadmap to address “what if” the parties end up in divorce. To be valid in Pennsylvania, a prenuptial or postnuptial agreement requires that each party have separate legal counsel or at least an adequate opportunity to discuss the terms of the agreement with separate legal counsel and to understand the terms of the agreement before execution. These types of agreements may be set aside as invalid if found that a party did not execute the agreement voluntarily or if, before execution of the agreement, there was not a fair and reasonable disclosure of property and financial obligations or a voluntary and express waiver, in writing, of the right to any such disclosure, and insufficient knowledge or information about the property or financial obligations of the other party.

Alimony is a type of financial support paid from one spouse to the other after a divorce. It starts only after the divorce has been finalized. Not every divorced spouse is entitled to alimony. There are numberous factors which are used in Pennsylvania to determine if a spouse is qualified to receive alimony.

DUI/DWI
If all named policyholders on your auto insurance are 55 years of age or older it is possibe to qualify for a minimum discount of five percent on your automobile insurance. Pennsylvania law requires insurance companies to provide at least a 5% discount for each vehicle on a private passenger automobile policy under which all named policyholders are 55 years of age or older and have successfully completed an approved driver improvement course. 75 Pa.C.S.A section 1799.2 mandates the discount. Individuals must take an approved course every three years to remain eligible for the discount. Drivers can lose the discount if they are in a chargeable accident or are convicted of a moving violation or DUI related offense. Traffic Violations
This new restriction on the number of passengers is supported by research suggesting a link between the number of passengers and risky behavior by teen drivers. Research has shown that as the number of passengers increases, the likelihood of speeding and alcohol use also increases. The research also showed that potentially distracting loud conversation and horseplay were substantially more common with multiple teenage passengers in a vehicle. In addition to changes in the law, parents are urged to set and enforce rules that limit newly licensed drivers from driving with young passengers. Help reduce the risk of serious or even fatal auto accidents by following the law and limiting the number of passsengers riding with teen drivers.
Hit and Run
All automobile insurance policies issued in Pennsylvania must offer "uninsured" and "underinsured" motorist coverages to policyholders. In general, "uninsured" coverage protects you if you are injured in an automobile accident with an uninsured driver or a "hit and run" driver. "Underinsured" coverage protects you if you are injured by a driver without sufficient insurance coverage. While both types of coverage must be offered, you are free to reject this additional protection when purchasing your automobile insurance policy. We never recommend rejecting this important protection but you are free to make this choice. If you choose to reject "uninsured" or "underinsured" coverage, your insurance company must strictly comply with the requirements of Section 1731 of the Motor Vehicle Financial Responsibility Law. Section 1731 requires insurance companies to provide you with a very specific notice regarding your right to coverage. The law also requires the insurance company to obtain your signature on the notice to evidence a knowing and voluntary rejection of the coverage. If you have been injured in a accident but had rejected uninsured or underinsured motorist coverage, you should have a skilled attorney review the paperwork associated with your policy. Even minor deviations from the strict requirements of Section 1731 can invalidate your rejection of coverage forcing your insurance company to provide this important protection. Return to Top

Personal Injury
Most personal injury claims are settled by exchanging a single sum of money in return for a release of all claims against the defendant. In some cases, however, the parties are better served by negotiating a structured settlement which typically provides for an immediate cash payment and additional payments over time. This type of arrangement is typically referred to as a "structured settlement". The payments can be scheduled over any length of time or even on specific dates. I have had some clients set up monthly installment payments beginning on their anticipated retirement date in order to supplement retirement income. Others have scheduled lump sum payments to be made at or around the time tuition bills arrive each year. The point is, the settlement can be structured to meet the needs of the individual.
Medical Malpractice
A "Certificate of Merit" is required to be filed in any lawsuit that contains an allegation that a licensed professional deviated from a professional standard. This procedural rule, in effect since 2003, is applicable to all medical malpractice lawsuits filed in the Commonwealth of Pennsylvania. The requirement also applies to lawsuits against architects, CPAs, chiropractors, engineers, nurses, dentists, pharmacists and other professionals. The "Certificate of Merit" essentially certifies that another licensed professional has reviewed the matter and has supplied a written statement concluding that there is a reasonable probability that the subject of the complaint fell outside acceptable professional standards. The "Certificate of Merit" must be signed by either a party or their attorney and sanctions can be imposed if the certificate is filed improperly. More importantly, the Rules of Civil Procedure allow a court to enter a judgment of non pros and essentially dismiss the case if a "Certificate of Merit" is not filed in accordance with the rules. Slip and Fall Injury
With the first hints of snow in the weather forecast, it is a good time to review liability for slip and fall injuries under Pennsylvania law. Unfortunately, falls on ice or snow are common in winter and can result in serious injury. Generally speaking, property owners in Pennsylvania have a duty to remove snow and ice from their sidewalks and walkways in a reasonable amount of time after an accumulation. Pennsylvania law does not, however, require a property owner to keep sidewalks and walkways free of snow and ice at all times. Given the unpredictable weather in Northeastern Pennsylvania, this would be an impossible standard to meet. Instead, courts have developed the "Hills and Ridges Doctrine" to evaluate slip and fall claims due to wintery conditions.
