Declaring bankruptcy by filing for Chapter 7 or filing for Chapter 13 is another means of stopping collection attempts and the most effective means of stopping wage garnishment. When you declare bankruptcy, the automatic stay immediately goes into effect. The automatic stay prohibits creditors from making further collection attempts and, at least temporarily, stops wage garnishment. If the debt that resulted in your wage garnishment is completely discharged, or eliminated, by the bankruptcy proceeding, the garnishment is gone forever. However, garnishment can be reinstated for certain debts not wiped out in bankruptcy, such as child support obligations and back-taxes, after the automatic stay lapses. That does not mean that the process was worthless. Whether you made use of liquidation or a payment plan, you likely have reduced your debt burden so you can more easily pay down the nondischargeable debts.
