Child Support

Child Custody and Visitation

Celeste Kling has successful mediation experience in all of these areas for over twenty years. Mediation has gained popularity in the legal environment primarily because it is a more civilized, and often a more economical, path than either litigation or arbitration.
Adoption
The person who is adopting a minor child may be single or married, but if a person is married both spouses must adopt the child (unless it is a step-parent adoption). Colorado law also allows second-parent adoptions, which permit a same-sex or unmarried partner to adopt a child in some situations.
Guardianship
Elder law involves a number of areas including Medicaid, Medicare, Social Security, health care and aging issues, probate, estate planning, guardianships and conservatorships. Qualified representation in these critical situations often makes a dramatic difference for older citizens. Nancy Wallace has extensive expertise in elder law issues.

T he process of obtaining a divorce (dissolution of marriage) or a legal separation can be stressful and confusing. Wallace & Kling, P.C. offers a variety of legal services to assist family members resolve divorce issues as they go through this process. Social Security Disability
Nancy Wallace is no longer accepting Social Security disability cases. If clients have other issues involving Social Security, such as overpayments, entitlement to benefits and financial eligibility for SSI, she will provide advice only on those cases.

Trusts and Estates

Estate Planning
Adoption of a child causes the child to become the legal child of the adoptive parents for all purposes, and results in the issuance of a new birth certificate for the child, listing the adoptive parent or parents as the birth parents. Colorado also recognizes adult adoptions. Adoption of an adult simply makes the child equivalent to an heir at law of the adoptive parent; it is an estate planning tool.
Wills
Often, the estate planning process is as simple as an initial meeting with either Celeste Kling or Nancy Wallace and the client(s) and the client’s signing of a will at a second appointment. In more complex cases, the documents may include trusts, powers of attorney, deeds, marital agreements, establishment of limited liability partnerships or companies, and/or other documents. As part of our estate planning process, we offer clients medical powers of attorney and living wills at no additional cost.

Power of Attorney
A. Effective March 1, 2007, payments to family members for personal services (running errands, bill paying, etc.) will be deemed to be a gift unless there is a written agreement prior to delivery of services. The written agreement must meet specific guidelines and payments may not be made to a family member who is also the agent under a power of attorney.
Probate
Guardianships and conservatorships are also considered probate law issues, and Nancy Wallace offers advice in these matters. Celeste Kling offers mediation services regarding probate administration, guardianship and conservatorship issues.
