Divorce

Child Support
The person obtaining custody is able to make all decisions regarding the health, education, and maintenance of the minor child, and is able to obtain child support from the non custodial parents.

Grandparents do not always lose their rights in a custody dispute. However, they may lose their rights. Further, there is a statute to help preserve their visitation rights.

Guardianship
If a person is a minor, then that person must have a GUARDIANSHIP opened. This can be a guardianship of the property of the minor, which would be analogous to a Conservatorship (mentioned above); or it can be a guardianship of the person, where a formal relationship is required between the caretaker and the disabled person, such as a child who lives with an aunt or uncle and must have a guardianship established before the aunt or uncle can enroll the minor in the local school; or it can be both.
Spousal Support
Alimony is based, principally, on need and ability to pay. The legislature has mandated that the alimony be principally rehabilitative, meaning that the economically disadvantaged spouse is to receive an amount of alimony for a limited time to help that spouse finish an education, resume a career, or start a career. However, our Courts have legislated on their own by imposing another type of alimony by their "interpretation" of the law. Basically, this type is where there is a long term marriage, the economically disadvantaged spouse is not given an amount of alimony to restore he or she as near to the standard of living he or she enjoyed while they were married. This may be for a period of years or for life.

Criminal Defense
These are generally not really criminal matters. They usually carry only a fine, and are civil in nature.
DUI/DWI
However, certain traffic cases such as vehicular homicide are felonies, and certain traffic cases such as Driving under the influence (DUI) or driving on a revoked or suspended license are misdemeanors.

Municipal Courts This is a Court of a municipality such as Bartlett, Germantown, Collierville, or Millington. These Courts can conduct trials of traffic cases and misdemeanors. The traffic cases involve only violations of city ordinances. These Courts can only hold preliminary hearings of felonies. A preliminary hearing is held to determine if enough evidence exists to refer the case to the Grand Jury for indictment and trial in Criminal Court. The preliminary hearing also can lead to dismissal if no evidence is found.

These cases are based on the law of negligence, except for Workers' Compensation, which is based on a statute enacted by the Legislature to protect workers.

Property Damage
G. Further, we will need you to provide us with a copy of all items for which you have lost money because of this accident. This includes estimates from body shops for your property damage, and estimates to replace personal property items lost or damaged in the accident. We will need copies of invoices (if available) showing what you paid originally for items which would have been lost or damaged in the accident. Further, we would need copies of any receipts for the purchase of new glasses, new dentures, or any other items which you have had to purchase as a result of this accident.

In Tennessee, THE STATUTE OF LIMITATIONS IN PERSONAL INJURY ACTIONS (injuries to the person) IS ONE YEAR FROM THE DATE OF THE COLLISION. The Statute of Limitations for property damage (not injuries to the person) is three years from the date the accident happens.
Medical Malpractice
Costs prior to the filing of a lawsuit are generally less than $150.00, unless an investigator is hired for special investigation, or unless doctors must be obtained for evaluation of a medical malpractice case, in which the event the cost would be $650.00 and up.

A) Social Security Disability - This is a monthly payment based on the F.I.C.A. deductions which were paid from your paycheck to the Internal Revenue Service. It is like paying premiums on a disability insurance policy. You receive a monthly benefit if you are disabled based on the amount of income that you had.

Approximately five days after your interview in our office where you have signed all of your petitions and documentation to be filed in Court you should call our office to obtain your bankruptcy number. This is the number that the Court uses and is called a DOCKET NUMBER. If any creditor or collection agency calls you or any one has threatened to repossess your car or has started foreclosure proceedings you should call this creditor and tell them the bankruptcy number. Also inform them if they start to question you, that ALL communication is to be through your attorney THE COHN LAW FIRM in as much we have instructed you to do so.
