Criminal Defense
My experience in the area of criminal law spans a period of 50 years, and includes 20 years with the New York State Police, and a 7 year term as City Court Judge in the city of Mechanicville.
DUI/DWI
You can be charged with driving while intoxicated (DWI) if you drive with a blood alcohol content of.08% or greater, irrespective of whether your driving ability was truly impaired, or if you operate a vehicle while impaired by alcohol to a substantial extent. You can be charged with driving while ability impaired (DWAI), which is a less serious charge, if your capacity to operate a vehicle as a prudent, reasonable driver has been adversely affected because you consumed alcohol, drugs, or a combination of the two.
Traffic Violations
Mr. Hughes is a former zone sergeant with the New York State Police who understands how a police officer thinks when making an initial stop or an arrest. He can vigorously defend a motorist who has been arrested for a traffic violation or for driving while intoxicated. Mr. Hughes has two offices in upstate New York. He is highly respected and trusted by the legal community and understands the workings of all of the local courts.
Misdemeanors
Crimes can be divided into misdemeanors and felonies. All crimes need to be proven beyond a reasonable doubt, which is a tough burden. Even so, you should consult an experienced attorney about your situation because prosecutors usually do not bring charges unless they have built a reasonably plausible case. Usually, the first appearance before a judge is the arraignment. At the arraignment, if you ask for the assistance of an attorney, the court is supposed to stop the arraignment process so that you can contact an attorney. The prosecution and the defense usually negotiate to figure out whether the matter can be resolved through a plea bargain rather than a trial. Assault
Homicide
The law requires bail to be set for serious DWI violations (D-felony) and any felony level criminal violations resulting from the DWI. Some examples are criminally negligent homicide, vehicular assault and vehicular manslaughter, manslaughter, and aggravated unlicensed operator. Except for the above, the ultimate release decision is discretionary on the officer taking into account the probability of the accused to reappear in court for arraignment.
Restraining Order
Order of Protection: One of the most serious documents which may be issued by a court is an Order of Protection, sometimes incorrectly referred to as a Restraining Order. These orders are frequently issued in matters where the criminal conduct includes some illegal personal conduct or threats of illegal personal conduct between the victim and the perpetrator. Orders of Protection can greatly restrict any future personal contact between the parties. They can order one party out of the family residence, and restrict contact by personal or electronic communication between the parties. A violation of the Order of Protection by itself constitutes the crime of criminal contempt (a misdemeanor or in some cases a felony). It goes without saying that most judges react unfavorably to violations of their orders.
Manslaughter

Property Damage
Most violations of the Vehicle and Traffic law are petty offenses, and a police officer is only authorized to file charges on petty offenses actually committed in the officer's presence. There are two exceptions to this general rule specified in the Vehicle and Traffic Law. They are driving while ability impaired by alcohol (1192-1 – traffic infraction) and leaving the scene of a property damage accident.
