Wrongful Termination
Employees who have been subject to wrongful termination may be able to recover lost wages, compensatory damages, punitive damages, attorney fees and be reinstated in their previous job.
Employment Discrimination
Title VII of the Civil Rights Act of 1964 is often utilized to bring suits against employers who discriminated against an employee due to their race, color, national origin, sex, or religion. The Age Discrimination in Employment Act (ADEA) and the Americans with Disabilities Act (ADA) make it unlawful for an employer to discriminate due to age or disability, respectively. The Family Medical Leave Act (FMLA) also gives rights to an employee who needs to take medical or family leave from work for an extended period of time.
Employment Contract
Many federal and state statutes exist to protect employees from being wrongfully terminated. Federal and state whistle-blower acts have been enacted as well as the Court created retaliatory deischarge cause of action. Several laws also exist that make it illegal for for an employer to violate a collective bargaining agreement or other employment contract.
Severance Agreement
Often, when an employee is terminated from their employment, they receive a Severance Agreement. Severance is extra pay offered to encourage en employee to retire, resign, or settle a claim for discharge. This Agreement often contains many clauses and sections which can severely limit an employeeâ€™s right to recourse against their employer for unlawful activities. Further Severance pay can often be negotiated upward. It is best to have an experienced attorney review these documents before you sign them. At Barry A. Sexual Harassment
Many protections exist to ensure that women are able to work in an environment free of sexual harassment. It is illegal for a woman to be discriminated against in any hiring, termination, or displinary action. A. womanâ€™s work environment is to be absent of any sexually harassing behavior such as sexual advances or a hostile work environment. Sexual harassment includes unwanted sexual approaches including touching, or degrading remarks. These approaches or remarks are usually made with the suggestion that an employeeâ€™s status depends on cooperation or a positive response.
