Divorce
The state has made a major change to the no-fault divorce law. If you have filed for divorce and fall under the two-year waiting period, that is being shortened to a one-year waiting period. The new law goes into effect in 60 days. On July 2, 2012, Fayette County Court of Common Pleas Judge Ralph C. Warman officially retired. He was greeted by family, friends and colleagues with a surprise luncheon in the Courthouse Gray Room. As he entered the room to resounding applause, I could not help but think back to the very first day I met him. Both of us were young assistant district attorney's eager to become successful prosecutors and trial lawyers. From the moment we met, he impressed me with his ingratiating smile and warm gestures. I soon came to realize that he was something special. In those years as assistant district attorney no one worked any harder or provided more support to the staff than Ralph Warman. If you were in the middle of a trial and needed some quick research, the next thing you knew he was handing you a case on point. If you had to interview a witness at 2:00 A.M. during the middle of a homicide trial, he would go along with you. He rose through the ranks of the district attorneys' office under the direction of then district attorney, and now president Judge Gerald R. Solomon, and was eventually elected district attorney. Prosecutors and defense attorneys alike would all agree he did an outstanding job as Fayette County's district attorney.

Workers Compensation

When a person dies solely owning an interest in personal property or real estate, an estate administration usually will be required. In any case, death or income tax matters must be considered.
Wills
If you are involved with a person who has died, make sure that their home is secure and nothing is lost or destroyed. In Pennsylvania, other than a spouse, no one can enter a safe deposit box without arranging an inventory for the Pennsylvania Department of Revenue. Shortly after the funeral, an attorney should be contacted by the survivors to discuss the decedent's (the deceased person) matters and estate. The attorney will provide advice, determine whether administration will be required and explain what procedures will be involved. If there is a last will, the person named as executor should protect the original of it and give it to the attorney at the first meeting.

A durable health care power of attorney includes provisions which are commonly referred to as a living will. This document is a written statement that allows you to retain control over whether or not your life should be prolonged by the use of artificial means in a case where you are incompetent and have a terminal condition or are permanently unconscious. The statement tells your family and friends of your wishes and instructs your doctor and other health care providers whether or not to medically prolong the process of your dying or keep you in a state of permanent unconsciousness, with no hope of recovery. It is to be followed if you are unable to provide instructions at the time the medical decisions need to be made and allows you to authorize the withholding or withdrawal of all treatment and procedures.
