Wrongful Death
Parents in Bowie and Waldorf of a 6-year-old boy settled a wrongful death case against a neighborhood association for the dangerous construction of a dam in the child’s back yard. Engineering experts hired by Alpert Schreyer to investigate the construction of the stormwater management pond determined that a concrete wall, which was part of the dam was not built to code for a residential neighborhood.
Traffic Violations
In Maryland, negligent boat drivers may face civil and criminal liability. The state may charge a negligent boat driver for reckless driving, gross negligence, or boating while intoxicated. All carry heavy fines. Please remember to be safe each boating season. Always leave plenty of space between you and other boaters and be sure to review the safety guidelines set forth by the United States Coast Guard. Always wear a life jacket while on a boat.

Homicide
Workplace deaths from injury have been decreasing in recent years, according to the Maryland Division of Labor and Industry Regulation. In 2008, the last year in which Maryland collected data, 60 people lost their lives in workplace accidents, down from 82 in 2007 and the lowest number of recorded deaths since Maryland began keeping track in 1992. The most common causes of workplace injuries leading to death were falls, homicide, electrocution, and motor vehicle accidents.
Manslaughter
During his time as an Assistant State’s Attorney, in addition to his sizeable caseload, Mr. Berman was responsible for screening DUI cases, sifting through hospital records, conducting competency hearings, and training colleagues on DUI case law. He started on the District Court team, before being promoted to the Circuit Court, and ultimately to the Auto-Manslaughter Trial Team.

Property Damage
Anytime you head out on the road in Maryland, you are at risk of being involved in an accident. Some accidents are “fender-benders†between two smaller cars, and you may walk away without a scratch or with only minor property damage. On the other hand, some crashes may happen at highway speeds between your small passenger car or SUV and a large semi-truck. In this case, the accident may completely change the course of your life.

Medical Malpractice
From a young age, Mr. McCubbin was driven to practice law by a desire to advocate on behalf of victims and fight for their right to recover from harms they have suffered. His competitive spirit led him to the area of medical malpractice, where he is focused on helping clients receive compensation and future medical care, after having suffered serious loss, death, or injury through no fault of their own. Throughout his career, Mr. McCubbin has seen how the system is built to protect doctors, hospitals, and their insurance companies, and he spends his time fighting against that inequity in order to help victims and their families.
Auto Accidents
Social Security Disability
Maryland also sets a minimum benefit for workers who suffer permanent total disability, which in 2012 was $50.00 per week regardless of what the worker actually made in the 14 weeks prior to the injury. These workers may also be eligible for federal Social Security disability or other benefits, which must be applied for separately from workers’ compensation.
