Generally, a plaintiff in a personal injury case must prove by a preponderance of the evidence that a legal duty existed, that legal duty was breached, and the breach of that duty was the proximate cause of harm. However if an out of court settlement does not occur, the case is ultimately tried in court, where a judge or jury will decide who was at fault and then on the amount of damages which include the resulting physical and emotional pain and suffering, injury, medical and related expenses, loss of earnings, loss of earning capacity and possibly loss of consortium.
