Finally, our practice is expanding to meet the needs of our long-time family clients who age out of special education protection. Business Disputes
The firm represents owners/landlords of commercial properties in a variety of settings, including contract disputes and eviction proceedings.Â In addition to litigation, the firm can evaluate an ownerâ€™s leasing program, and suggest revisions to lease forms, and notices, and assess in-house procedures to streamline the collection and eviction process.
Business Transactions
Mr. Castiglione also represents employers concerning matters involving the New York State Insurance Fund regarding insurance coverage for employees, as well as employers concerning transfer of experience ratings involving assessments by the New York State Department of Labor Unemployment Insurance Division, relating to business transactions.
Construction Contracts
From large multi-national corporations to individually owned businesses, Young/Sommer LLC has represented hundreds of clients through project development. The firm has extensive experience negotiating and preparing agreements for a broad variety of commercial real estate transactions involving improved and unimproved properties, including purchases, sales, leases, options, rights of first refusal, easements, conservation easements, declarations of restrictive covenants, and construction contracts. We have represented borrowers in a variety of financing transactions, including loans, construction loans, land development loans and refinancings. We have represented landlords and tenants in the drafting and negotiation of commercial and residential real estate leases.

Non-compete Agreement
Mr. Castiglione also works with both private businesses and individuals dealing with non-competition/ non-compete agreements and related issues, including drafting agreements, working with clients to understand their rights under such agreements, and representing companies and individuals dealing with enforcement and defense of lawsuits involving alleged violations of non-competition/non-compete agreements.

Real Estate Litigation
Construction Litigation
Steve has been siting major electric generating facilities since the late 1990s under the expired Public Service Law (PSL) Article X and continues to site utility scale renewable generating facilities under the current Article 10.Â Steve also assists developers in siting small scale renewable generating facilities (sized less than 25 megawatts), including related tasks such as preparing Engineering, Procurement and Construction agreements, and provides advice and counsel such clients on existing and proposed federal and state regulatory policies impacting development, ownership and operation of renewable generating facilities as well as regularly assisting in the transfer and acquisition of such facilities. Steve also provides regulatory advice and counsel to developers and owners of major electric and gas transmission lines subject to NY PSC approval under Article VII of the PSL.
Real Estate Transactions
Lindsey R. Dodd is a seasoned litigator with extensive experience representing clients through all aspects of the adversarial process, including developing strategies, formulating the necessary documents and papers to pursue or defend a matter, motion practice, disclosure, and trial. A diligent advocate, Ms. Dodd currently represents several municipalities, and in addition to litigation, her practice includes real estate transactions, corporate formation, and municipal law. She is actively licensed to practice in NY, NJ, CT, NH, PA, and the EDPA, and barred but inactive in two other states.
Eminent Domain
Mr. Castiglione alsoÂ works with clients on zoning issues relative to development projects, including working through the State Environmental Quality Review Act review process. Mr. Castiglione also works with municipalÂ entities in the eminent domain process when those municipalities are engaged in public use projects, as well as represents land owners in valuation litigation seeking to obtain their full and fair value for lands appropriated by government entities through eminent domain.

Young/Sommer LLC was founded in 1999 as the merger of two smaller Albany, New York firms with complementary legal practices in the general area of environmental law and zoning and land use planning and development: Young & Ritzenberg (established in 1992) and Ward, Sommer & Moore (established in 1995). Today, we are a medium sized law firm of 15 attorneys, with additional attorneys as â€œof counsel.â€
Landlord-Tenant Disputes
J. Michael Naughton is a partner in the firm.Â Mr. Naughtonâ€™s practice includes commercial litigation, real estate development, and land use and permitting for a variety of projects.Â His landlord-tenant practice focuses on representing shopping center owners across the State.Â Mr. Naughton has successfully defended Article 78 proceedings challenging approvals for regional shopping centers, telecommunication (cell towers) facilities, and wind farm projects in state and federal courts.Â Mr. Naughton is the Town Attorney for the Town of New Scotland, where he resides.

Personal Injury
Kristin has extensive experience managing and strategizing civil litigation matters for a variety of clients, including large and small corporations, municipalities, and individuals. She has had an active leadership role in all aspects of each case, including legal research and writing, discovery, oral arguments, motion practice, settlement negotiations, appeals and trials. Kristin was directly involved in the development of a Commerce Clause case that reached the United States Supreme Court, she achieved a multi-million-dollar verdict in the only plaintiffâ€™s personal injury case she ever pursued, she served as trial counsel in a white-collar criminal jury trial involving complex environmental issues, and she has successfully defended and resolved hundreds of commercial litigation matters, including complex multi-million dollar and multi-party actions. Ms. Roweâ€™s primary areas of practice are environmental, toxic torts, land use, insurance coverage, and commercial and contract disputes, but she has experience in a wide variety of matters.
