Child SupportChild support payments are largely controlled by statute. Our legislature has crafted a payment table that provides for different monetary amounts for child support based on the monthly income of both parents and the number of children to the marriage or relationship. The amount of child support paid by each parent will be adjusted according to each parent’s share of the total income calculated for both parents. The parent with whom the child spends the most time typically receives the child support from the other spouse. Child support payments can be handled in several ways. Child support can always be paid directly to the obligee, or the person who is to receive the child support. Child support can be ordered to be paid to a central depository, which is then distributed by the State Disbursement Unit. Finally, child support can be subject to an Income Deduction Order (IDO). If you fear that your spouse will forget to pay or will fall behind in payments, then an income deduction order may be right for you. Under these orders, the child support is deducted directly from the person’s paycheck. The child support is collected by the State and then disbursed to the person receiving the child support.
