Divorce

Child Support
Paternity means fatherhood. Arizona law requires that both parents of a child be responsible for the childâ€™s upbringing. While it is generally fairly easy to determine the mother of the child, the identity of the father may require proof. If a man admits paternity then he automatically assumes the responsibilities of raising a child. If a man denies paternity, the mother may file a paternity suit. If the mother proves that he is the father, he may be required not only to provide back, current and future child support, but also to pay for the cost of pregnancy and childbirth expenses.
Paternity
There are many different types of family law cases. Divorces, military divorces, legal separations, spousal maintenance, paternity suits, legal decision-making, parenting time, child support, grandparents' rights, relocations, and orders of protection in domestic violence suits are just a few of the wide range of family law legal matters that I have dealt with over the last four decades. Premarital Agreement
A Prenuptial Agreement is a written agreement entered into by parties contemplating a marriage. A Prenuptial Agreement must be signed by both parties and becomes effective on their marriage. Prenuptial Agreements are governed by theArizona Uniform Premarital Agreement Act, A.R.S. Â§Â§ 25-201, et seq.
Spousal Support
Spousal maintenance or alimony is spousal support ordered to be paid to a nonworking or unemployed or underemployed spouse during or after a divorce proceeding. Spousal maintenance can be temporary (awarded during the pendency of the divorce proceeding) or permanent (awarded in the Decree of Dissolution of Marriage) or both.
Legal Separation
If you are a party to an action for dissolution of marriage or legal separation and own joint, common or community property, then you may wish to enter into a property settlement agreement which is sometimes referred to as a marital settlement agreement.
Annulment
The most common reason that a marriage is annulled is fraud. This usually means a failure to disclose some important fact to your spouse like a communicable disease, an inability to have children, or a criminal past. Other common reasons are bigamy, incest or duress. With few exceptions, anyone who marries before the age of consent can have their marriage annulled. A good rule of thumb is, if you would not have married the person knowing what you now know, and that reason is serious enough to constitute fraud, either by commission (for example, lying) or omission (neglecting to tell you the truth), you may be a candidate for an annulment.
Child Abuse
If one of the parties desires to modify legal decision-making, a hearing under A.R.S. Â§ 25-411 must be held. If a parent fails to comply with a joint legal decision-making order, a hearing modifying joint legal decision-making cannot be held for six months after the entry of the decree unless there is domestic violence, spousal abuse, or child abuse. Otherwise, a petition to change legal decision-making may not be filed for one year after the entry of the decree unless the court finds that there is reason to believe that the childâ€™s present environment may seriously endanger the childâ€™s physical, mental, moral or emotional health.

Criminal Defense
Susan Schauf represented me in several misdemeanor criminal matters. Susan got two warrants quashed, several fines reduced and all of collections and other requirements decreased or extinguished. Misdemeanors
A police officer may arrest a person, with or without a warrant, if there is probable cause to believe that a person committed domestic violence. Domestic violence means attempting to cause or causing bodily injury or placing a victim in fear of imminent physical harm by threat of force. Domestic violence may be charged as a misdemeanor or a felony.
