HomicideIn 1978, Mr. Silverman received a National Science Foundation Fellowship to study the causes of homicide involving children ages 15 to 17 at the University of California, Berkeley School of Public Health, where he earned his master's of public health in epidemiology.
Restraining OrderTo prevent your abuser from contacting you or your children, you can obtain a restraining order from the civil court. Usually, the court issues an emergency order that becomes active as soon as your abuser is served. The court then schedules a hearing to decide whether to extend the order and for how long. The abuser faces criminal charges and a potential jail sentence for violation of a restraining order. Our family lawyers help you prepare for your hearing and remain with you throughout the process.
Tax LawDivorce imposes new tax considerations and rules that we take into account during mediation or collaborative sessions. The Internal Revenue Service (IRS) allows the spouse paying support to deduct the amount of spousal support from income and requires the recipient of the support to claim the amount as taxable income. Child support is not deductible or taxable as income. We include the tax implications in our calculations and advise you about the tax consequences of your support issues. If it is to your benefit, we may guide you toward other division of property alternatives to avoid detrimental tax problems. We work with a variety of CPAs and forensic accountants in the Bay Area to assure the proper consideration of tax issues related to support and property division.
DivorceThe collaborative divorce technique is an alternative method for resolving dissolution issues. It allows a couple to reach an agreement in a calm, cooperative and non-adversarial environment. The focus of collaborative law is for both parties and their attorneys to make a commitment to the settlement process through cooperation.
Child SupportA decrease in your financial resources may make it difficult to pay the amount of child support ordered in your divorce decree. Your changed circumstances may result from a lost job, a failed business, or a destroyed home due to a fire or natural disaster. Alternatively, the other parent may have won the lottery, received an inheritance or benefited from a lucrative business buyout that could help support your children's upbringing. Also, children who develop special needs or disabilities, possibly because of a serious illness or injury, may require additional support to get the treatment and care they need. Since child support may be modified at any time during a child’s minority, agreements to set bind the parents to future child support payments are invalid.

Premarital AgreementPre-partnership agreements — You can protect your rights to your separate property should your relationship end by entering into a partnership contract similar to a prenuptial agreement.
Spousal SupportSpousal support is intended to provide the spouse who earns the lower income with financial means of support from the spouse who earns the higher income. Depending on your individual circumstances, the court may order a lump sum or monthly support that is permanent or temporary. The same laws apply when a domestic partnership dissolves. Partnership support refers to the financial obligations and rights of domestic partners.
Legal SeparationLegal separation may be preferable for couples wishing to live apart and wanting formal decisions made about money, property and parenting issues. Other reasons for obtaining a legal separation instead of a divorce include religious beliefs, and maintaining health insurance and other benefits.
AnnulmentClients often have misconceptions about annulments. Broken promises about fidelity, lies about financial or social status, or even the hiding of a criminal record have been found to be insufficient grounds to support a claim of fraud. On the other hand, misrepresentations about the desire to have children or fertility, or presenting proof that a party married only for immigration purposes have been found to be sufficient to support a claim of fraud.
Child AbuseOur lawyers each have 20 years of experience guiding victims of abuse toward solutions. Attorney Alan Silverman has 15 years of experience in family counseling and psychology, and he was on the San Francisco Juvenile Dependency Panel from 1995 to 2008 litigating hundreds of child abuse and neglect cases.
