Child SupportWhen the Complaint is filed, the Family Court will assign a date for the Temporary Hearing. In York County, this hearing is usually set within thirty (30) days of the filing date. Â At this hearing, the presiding Judge will make a preliminary decision on all of the relief that has been requested. In other words, the Judge will decide parenting time with the children, who gets the house, how much child support is warranted, whether anyone will have to pay alimony, whether one side has to pay for the otherâ€™s attorney fees, etc.Â
Child Custody and VisitationIn South Carolina, the welfare of the child and the childâ€™s best interest is the primary, paramount and controlling consideration of the court. Â Cook v. Cobb, 271 S.C. 136, 245 S.E.2b 612 (1978). Â There is also a rebuttable presumption that custody of a child with the natural parents is in that childâ€™s best interest. Â Moore v. Moore, 300 S.C. 75, 386 S.E.2d 228 (1975). Â South Carolina, however, has recognized ways in which custody of a minor child may be best served in the hands of a non-parent.
Spousal SupportThe first step in a Family Court case is the filing of a Summons and Complaint requesting a divorce. This Complaint is required to list the legal reason for the divorce as well as any other relief that is requested.
