DUI/DWIIt is not illegal to drink and drive in Florida. It only becomes illegal to drive when your normal faculties are impaired. Your normal faculties include the ability to see, hear, walk talk, drive a car, judge distances and make decisions in emergency situations. Not everyone’s normal faculties are impaired when their body’s blood alcohol content (BAC) is above a.08, however, that is the standard legal limit in the State of Florida. Most people think that the legal limit in Florida is.08 or higher – but that’s not necessarily true. Someone could have a BAC of.09 and be perfectly fine. The flip side is that someone with a very low BAC, say.04, could be guilty of DUI. The key question is whether the person’s normal faculties were impaired.
Traffic ViolationsA very common criminal traffic violation in Florida is driving on a suspended license. It is also a common civil traffic violation. What’s the difference? Basically, a law enforcement officer has to determine whether or not you knew your license was suspended when he or she pulls you over. If they believe you did not know (or they just want to cut you a break), they can just give you a civil citation for driving while license suspended without knowledge. If they believe you knew your license was suspended and you are still driving, they can arrest you for driving while license suspended with knowledge! The only thing they may be standing between you and the county jail is your ability to convince the officer that you honestly did not know your license was suspended. I am not saying anyone should lie to any officer of the law – but I have seen cases where the officer made an arrest on someone who did not know their license was suspended.

Aside from a prison sentence and the general effect on your reputation and your personal relationships, you will be required to register as a sex offender indefinitely. This can prevent you from getting a job and can control where you live and travel.

BurglaryMost people associate burglary with stealing. In Florida, that is not always the case. In Florida, burglary is when you enter into another person’s home or vehicle with the intent to commit an offense. That offense does not have to be a theft. If you enter a home and commit a battery, you may be charged with a felony punishable by life called Burglary of a Dwelling with an Assault or Battery Therein. The key question will be whether or not you entered the dwelling with the intent to commit the crime.
MisdemeanorsPut simply, bonds exist to ensure the defendant will return to court to resolve the case. If you are arrested for a petit theft, perhaps a $250 bond is sufficient. Most people won’t risk blowing off court for a simple misdemeanor that has a maximum 60-day sentence. Failing to appear will result in forfeiture of the $250, which (to most people) isn’t the end of the world. However, the Judge will issue a warrant for your arrest and could suspend your license (with what is called a D-6 suspension). So the next time a cop runs your license plate or pulls you over, you are going back to jail – and this time, there will not likely be another bond.
Drug CrimesDrug charges can result in minimum mandatory jail sentences and other serious penalties, including a permanent criminal record. If you are facing drug possession, distribution or trafficking charges in Florida, consult a knowledgeable lawyer immediately to protect your rights and work toward the best possible outcome.
AssaultOn the flip side, if you are arrested for a much more serious crime like aggravated assault with a firearm (which carries a 3 year minimum prison sentence if you are convicted), a bond will need to be higher even if you don’t have any criminal history. The amount of the bond may differ from person to person. If you are like most Americans, a $5,000 will be sufficient to ensure you return to court. But if you have $50 million dollars in the bank and are just in Florida on vacation and you’re getting ready to fly back to Australia, you probably need a higher bond.
MurderA fourth DUI, regardless of when prior convictions occurred, and Murder with Motor Vehicle: Mandatory permanent revocation. No hardship reinstatement.

ShopliftingProbably the most common form of theft in our society is shoplifting or petit theft. This is where the item taken is not of significant value. If the item taken is worth less than $100, then it is only a second degree misdemeanor. If it is worth $100 or more but less than $300, it is a first degree misdemeanor. Additionally, if you ever have a prior conviction for any theft charge and are charged with petit theft 2nd degree, it automatically gets upgraded to a 1st degree misdemeanor because of that prior.
Restraining OrderInjunctions are essentially restraining orders. They prevent someone from doing something or coming into contact with another person. The petitioner files an injunction with the court against the respondent.
KidnappingFlorida’s anti-murder act may also prevent you from getting released on bail. The anti-murder act will preclude your ability to be released if you are on any felony probation and commit certain felony offenses, such as kidnapping, carjacking, robbery, murder, sexual batter and many others. If you are arrested for any of the listed offenses while on felony probation, you will be summarily denied a bond under Florida’s anti-murder act.
ManslaughterDUI Manslaughter: Mandatory permanent revocation. If no prior DUI related convictions, may be eligible for hardship reinstatement after 5 years.
