Investor VisasBusinesses people / entrepreneurs who make an investment in a commercial enterprise in the US and plan to create or preserve jobs are eligible to apply for a Green Card through investment. Immigration and Nationality Act § 203(b)(5) of the (INA), and 8 U.S.C. § 1153(b)(5), 10,000 immigrant visas are available each year to qualified individuals seeking permanent resident status on the basis of their engagement in a new commercial enterprise. Of the 10,000 annual investor visas, 5,000 are set aside for those who apply under a pilot program involving an USCIS-designated “Regional Center.”

DUI/DWIThe Intersection of Immigration and Criminal Law. Everyday across the United States, green card holders and other immigrants find themselves arrested on various criminal charges ranging from drunk driving to drug possession to domestic violence. Many of these immigrants have never been arrested before and find the experience traumatic. As a result, in an effort to bring this experience to what they believe is a quick end, they often accept plea deals that have disastrous consequences on their immigration status. These consequences may arise immediately, such as when Immigration and Customs Enforcement takes them into custody immediately after their criminal sentence ends. Oft times, these consequences do not arise until years later, such as when the immigrant applies for citizenship only to be arrested by Immigration and Customs Enforcement because of a criminal conviction from many years ago. Sex CrimesThe immigration law provides that in certain cases, a person who has suffered substantial physical or mental abuse as a result of having been a victim of a crime will qualify for the U nonimmigrant visa. In order to qualify for the U visa, the victim must possess information concerning a criminal activity that violates federal, state or local law relating to rape, torture, trafficking, incest, domestic violence, sexual violence or other specified crimes.
RobberyNon-citizens are subject to removal if convicted of a crime of moral turpitude. Many “crimes of moral turpitude” are relatively minor offenses and expungement does not cancel a conviction for immigration purposes. Crimes of moral turpitude include, but are not limited to, fraud, arson, blackmail, burglary, embezzlement, extortion, false pretenses, forgery, fraud, grand larceny, petit larceny, robbery, theft, possession of stolen property, abandonment of a child, adultery, assault, bigamy, kidnapping, lewdness, manslaughter, mayhem, murder, prostitution, rape, an attempt to do any crime of moral turpitude or being an accessory.
BurglaryThe INA authorizes the removal of non-citizens who have been convicted of an aggravated felony. These crimes generally refer to murder, drug and firearm trafficking, rape, sexual abuse, money laundering, crimes of violence, theft, burglary, kidnapping, child pornography, RICO offenses, running a prostitution business, fraud, forgery, obstruction of justice, and other crimes.
MisdemeanorsLance L. Fletcher, Esq. is a graduate of the University of Rochester and the University of Pittsburgh School of Law. He is admitted in Pennsylvania and New York. Upon graduation from law school in 2004, Lance was appointed as an Assistant District Attorney at the Manhattan District Attorney's Office, a position he held from 2004 to 2008. While at the District Attorney's Office, Lance prosecuted thousands of cases including Felonies and Misdemeanors, was a member of both the Identity Theft Unit and the Domestic Violence Unit and conducted numerous jury trials. He is a member of the American Immigration Lawyers’ Association and American Bar Association.
Drug CrimesIn 2008 alone, there were almost 100,000 removals based on criminal offenses accounting for more than a quarter of all removals.
