We understand that often a parent is assisting their child with the charge and will work with parents and their children to obtain the best possible outcome for their family.
Drug CrimesOur firm will be able to use our experience in the criminal arena to help you understand your rights and options. We are able to advise as to whether you should proceed to trial if necessary, or if it is in your best interest to work out the best possible reduction of charges. In North Carolina, you can be charged with a felony or a misdemeanor. We handle all felonies and misdemeanors including driving while impaired, underage consumption, possession of marijuana, domestic violence, driving while license revoked, and financial crimes.
Restraining OrderRestraining orders can accompany criminal charges or they can be issued independently. There are two types of restraining orders in North Carolina in this context. One is between a spouse, family member, boyfriend/girlfriend and is issued upon a finding of domestic violence, and the other type of restraining order involves people who do not have a family or romantic relationship which is called a 50(c). The first type involves allegations of domestic violence and is called a 50(b), which is the statute number that sets out the terms and conditions. An entry of a 50(b) is not a criminal conviction but they can appear on your criminal history and a violation of a 50(b) is the highest class of misdemeanor in the State of North Carolina. 50(b)s can have numerous terms and conditions, and one of the main ones is that possession of a firearm is a crime. 50(b)s, when used appropriately, may provide relief to a victim that is in desperate need of help.
Child SupportHow custody is resolved and the amount of child support to be paid are frequently critical concerns as a result of a divorce, as they can also be very controversial and emotional. While these matters are very personal in nature, it is sometimes difficult to resolve them outside of the judicial process, which often makes it necessary to file an action with the courts.
Child Custody and VisitationWhen deciding matters related to child custody, the court will always consider what is in the best interests of the child. While the court recognizes the importance of parental rights, it may also terminate a parent’s rights when the best interests of a child are at stake.
Spousal SupportAs a result of a separation or divorce, either party may be awarded spousal support in order to make ends meet. In North Carolina, spousal support is based on the economic situation of the parties, plus other statutory factors, and may be awarded as post-separation support, alimony, or both. Post-separation support is temporary and usually set for a definite period of time. Alimony can be permanent, but usually is not. Additionally, an award of post-separation support does not automatically guarantee alimony. In either situation, the party seeking spousal support must prove that he or she is the financially dependent spouse and the other spouse is the financially supporting spouse.
