Went here for custody mediation-complete waste of time and money.
Scott Hall was late, unprofessional and unprepared-He didn't go over our paperwork, he had no concern for our child, basically said as a father I could only have a few summer days and that was it. No good communication skills and basically kept calling himself the judge so I should accept what he said.

Divorce
Child Support
Child support is a tool governed by mathematical guidelines created by the Idaho Supreme Court ( Idaho Rule of Family Law Procedure 126 ) to ensure parents are providing for the minor children’s physical needs. While they are guidelines, the courts in Idaho rarely deviate from this mathematical calculation. These guidelines can factor in many issues, such as custodial arrangements, the parties’ employable incomes, tax benefits for claiming minor children, insurance premiums. Apportionment of day care and health insurance costs are often dealt with in tandem with child support. Child support issues many times are much more complicated than they seem at first glance and revolve highly on the custodial arrangement of the children. Our family law attorneys help their clients navigate through these rules to ensure an accurate child support calculation.
Child Custody and Visitation
NELSON HALL PARRY TUCKER, PLLC offers divorce/child custody mediation through its mediation division. SCOTT R. HALL, has represented clients in divorce and child custody cases in Idaho since 1986. Mr. Hall has represented more than one thousand such clients and has mediated more than one thousand cases for the Courts.
Adoption
Guardianship
Our firm provides legal services in all manner of guardianships and conservatorships. Whether a case involves a minor or an adult, is contested or uncontested, or involves an incapacitated individual or developmentally disabled person, we have the experience to provide competent legal counseling and representation. Spousal Support
Spousal maintenance is available in Idaho for some cases of marriage where a spouse lacks sufficient property and is unable to support himself/herself through employment. Idaho Code § 32-705. There is no hard and fast mathematical formula to calculate Spousal Maintenance/Alimony like there is for child support. Spousal Maintenance (Alimony) may also be modified depending on the language of the decree. The Court, again, will be looking for a substantial and material change in circumstances to modify an award of support. If you believe you may be entitled to receive or are obligated to pay spousal maintenance, or you would like to modify it, we can encourage you to contact our office to evaluate your spousal maintenance questions.
Legal Separation
Legal separation is available in Idaho to suspend a marriage. This action is not required for parties to physically separate from each other. Instead individuals that seek a legal separation are usually attempting to preclude liability for the actions of the other spouse. However, legal separation does not suspend community property laws and will usually require a post-nuptial agreement to assign rights and obligations of the parties during the time of separation. If both parties cannot mutually agree on the terms of a legal separation, most often those cases result in a separate filing for divorce.
Annulment
An annulment is different from a divorce in that an annulment dissolves a marriage as though it never happened. There is no such thing as a no-fault annulment, like there is for a divorce. An annulment can often create difficulties in cases where the parties have amassed significant quantities of community property during the marriage. If you are considering an annulment, we encourage you to speak with one of our attorneys.

Wrongful Death
Mr. Tucker’s practice emphasizes on banking, business litigation, personal injury, employment, collection, real estate, and bankruptcy law. He regularly provides training to Idaho landlords and various financial institutions. Mr. Tucker also handles various personal injury and wrongful death actions and has settled individual cases in excess of $1,000,000.00.
Misdemeanors
If an employee is injured and the employer does not have workers’ compensation insurance at the time of the injury, the employer may become personally liable for the workers’ compensation benefits due to the injured worker, including the medical and disability benefits, as well as being liable for an additional 10% penalty. Further, failure to carry workers’ compensation insurance is a misdemeanor under Idaho law. Additionally, the Industrial Commission may file a lawsuit in District Court seeking an injunction to prohibit the employer from operating a business.

Mr. Parry concentrates his practice in estate planning, probate, taxation, corporate and business law. He graduated from BYU in accounting in 1983, then obtained joint degrees in 1987 with a Master of Accountancy degree with an emphasis in taxation and a Juris Doctor degree from BYU’s J. Reuben Clark Law School. Mr. Parry was admitted to the Utah Bar in 1987 and to the Idaho Bar in 1991.

Workers Compensation
Idaho’s workers’ compensation insurance is Idaho’s no fault system that provides lost wage benefits (temporary total disability (TTD) and/or temporary partial disability (TPD)) and medical benefits to workers with job related injuries or job related diseases. Nearly all employees in Idaho are protected by workers’ compensation insurance. State law requires most employers to have workers’ compensation insurance.
Wrongful Termination

Estate Planning
The firm provides complete and sophisticated estate planning counsel. We are experienced in preparing all manner of simple or complex wills and living or testamentary trusts. Our attorneys provide competent guidance in the probate of wills and the administration of estates and trusts. We counsel institutional and individual fiduciaries. When called upon, we also serve to litigate estate and trust disputes.
Wills
All members of our firm have experience in drafting wills and trusts, including living trusts, and planning and administering the estates of our clients.
Trusts
Probate may not be necessary to transfer all assets. For example, beneficiary designations on insurance policies, retirement accounts, annuities, and transfer-on-death accounts generally supersede the will or any trusts and are payable to the designated beneficiary. Likewise, accounts held in joint tenancy may be payable directly to the surviving joint tenant. Resolving issues related to joint accounts and beneficiary designations (especially if community property is involved) can be difficult and you should contact the estate attorney if you have any concerns or questions. If the decedent had a “living trust” established during lifetime, then assets transferred to the trust during the decedent’s lifetime typically do not need to pass through probate, but care should still be taken regarding potential creditor claims.
Power of Attorney
Note that if the decedent (while living) had an agent under a power of attorney, that agency relationship would normally terminate upon the decedent’s death. After death, it is the court-appointed personal representative who has the authority to act for the decedent.
Probate
The United States Supreme Court has ruled that under certain circumstances a known or reasonably ascertainable creditor must be given actual notice (rather than notice by publication) of the need to present a claim before failure to present a claim within a given time period will bar the claim pursuant to state probate law. If you desire to achieve certainty concerning barring known or reasonably ascertainable creditors, you should mail to each known or reasonably ascertainable creditor a notice explaining that they need to present their claims within the statutory time periods or be forever barred. If you desire, our office will prepare and mail these notices if you provide us with the names and addresses of known or reasonably ascertainable creditors.

Bankruptcy
Foreclosure

Tax Law
A federal estate income tax return (IRS Form 1041) for income received by the estate may be required for each year in which the gross income exceeds a certain level. The beginning of the first year is the date of death and may end the last day of any month which you select. An Idaho return (Form 66) for income received by the estate may also be required for each year for which a federal return is filed. If the estate is complicated at all, you would be well served to employ a CPA to assist with any tax reporting issues. Normally you should first consider employing the CPA utilized by the decedent before death as that person will be familiar with any tax issues facing the decedent.
