Divorce
Military divorces often present unique issues. FS 61.021 requires that a party reside in Florida for six months before filing a proceeding for dissolution of marriage. Florida courts have recognized an exception to the residency requirement for members of the military, allowing them to seek divorce in Florida without proving actual presence in the state during the six month statutory period.
Child Custody and Visitation
Contested vs. uncontested divorce: First, we will determine if your divorce is contested or uncontested. If you and your spouse can agree on everything, I will help you file for a simplified dissolution when there are no children and no assets in the marriage. A contested divorce will address child custody and support, visitation and time sharing, distribution of marital assets and liabilities, spousal support and insurance.
Premarital Agreement
A high net worth or high income does not necessarily mean that a divorce will be any more complicated or difficult than one with more modest finances. Often it is easier to resolve because there will be sufficient financial resources for both parties. However, many wealthy couples do have complex and sophisticated finances including trusts, family partnerships, closely held businesses and the like. In addition the spouses often have a prenuptial agreement that may or may not be valid under Florida law. Such cases mandate a higher standard of competence, care, experience and legal and financial sophistication for attorneys representing these spouses.
Spousal Support
Alimony can be awarded to either spouse temporarily through the dissolution process in the state of Florida, in a lump sum, in periodic payments, for a fixed number of years or permanently. Alimony is mainly based on the duration of the marriage and a showing of the spouseâ€™s need for financial support and the otherâ€™s ability to pay.

Criminal Defense
Often, the nature of past convictions influences current criminal defense efforts. For example, previous convictions may have less of an impact if they took place over a decade ago or occurred when the defendant was very young.
DUI/DWI
The nature of the previous crime may also play a role in how later cases are handled, with charges of the same nature often proving more damaging if seen repeatedly. With Florida DUI cases, for example, the severity of penalties increases dramatically with each additional conviction, as can the classification of the crime itself. A third DUI offense is deemed a felony and can prompt up to twelve months in jail and $5,000 in fines, versus just $1,000 for an initial conviction.
