Brock and Scott’s Litigation & Defense Practice Group has extensive experience in all types of litigation matters pertaining to lender/servicer defense, including but not limited to contract claims, collection and loan recovery disputes, lender liability claims, FDCPA, TILA, RESPA and real estate disputes. We also defend actions brought by borrowers or former borrowers, competing lienholders, municipalities, homeowners’ associations and other persons that may adversely impact the lien priority or property interests of our clients. The Litigation Practice Group understands how litigation can be an effective tool in meeting client objectives. In appropriate cases, mediation or arbitration may provide a more cost-effective method of dispute resolution. When litigation is necessary to protect the interests of our client, our Litigation & Defense Practice Group formulates a strategy designed to achieve the client’s goals. Our philosophy is to prosecute litigation aggressively while respecting the need to create and abide by a budget that is both realistic and appropriate for the particular matter. All litigation files are carefully managed, client communication is ongoing, and pending cases are systematically reviewed to ensure a continuing cost-benefit analysis throughout the process.
Construction Litigation
The firm offers effective solutions to its clients for any of their real property related matters and does so with a dedication to client communication and a reasonable cost and fee structure dependent on the client’s needs. The Real Estate Law group is led by Partners Jim Bonner and Kyle Kotake who have vast years of experience in all real estate matters, construction litigation and arbitration, commercial litigation, and general civil litigation while managing a multi-state practice.

Bankruptcy

Foreclosure
Brock &Scott’s Title Curative and Litigation group has extensive experience representing mortgage servicers, title insurance companies, property owners, banks, investors and other asset holders who seek to resolve challenging or complex defects in chains of title. We give our clients practical advice and work diligently to determine and fix the title defects first without the necessity of litigation. If litigation becomes necessary, we have experience addressing all manner of claims, such as quiet title, declaration of priorities, equitable subrogation, and breach of contract, fraud and foreclosure.
Debt Collection
The Consumer Financial Services Litigation group at Brock & Scott represents financial services entities in the area of litigation, specializing in the defense of individual and class action claims stemming from alleged violations of debt collection, credit reporting and other consumer protection statutes. The group also regularly handles complaints involving the Consumer Financial Protection Bureau, the Federal Trade Commission, state attorney generals and licensing boards and is skilled in handling civil investigative demands and other regulatory inquiries related to debt collection practices.
