Child Support
A Dissolution is a way to terminate a marriage that divides up the property and debt fairly and by agreement. It also addresses issues of child custody and child support. While the parties must agree to everything, the court still must be certain that what is agreed to is fair to the husband and wife and in the best interests of the children. And again, it is very difficult to alter the terms of child custody.
Child Custody and Visitation
It is a fundamental right to rear your children. When the state or another person tries to interfere with that right, you have many protections under the Constitutions both of the State of Ohio and the United States of America. If you are a fit parent, only the other parent can receive shared or sole custody. You do not have to agree to give anyone custody of your child and if you do, it can be very difficult if not impossible to get it back. In Ohio, if the parents are married and were married at the time a child was conceived, no one has a right to visit or custody unless both parents are unsuitable parents; however, if you are not married or no longer married or in the process of terminating the marriage, any person related by blood or marriage to your child has the right to ask a court for visitation rights regardless of your feelings.
Premarital Agreement
In Ohio, contracts are very powerful things. People who want to live together but don't want to get married or aren't sharing an intimate relationship can execute a co-habitation agreement which is similar to a prenuptial agreement. It will address property and liability issues when they stop living together in the event that they can't agree. For instance, if two college students decide to share an apartment lease, these can make separating property much easier if the friendship turns sour. In the event that one party is disabled or killed in an accident, these can also protect the survivor's property from the other's next of kin.
Guardianship
It is difficult to decide which court you should file in. Most people will file in Juvenile Court. Some people may file in Probate Court for a Guardianship of a Minor. People who have been in Domestic Relations Court before regarding a child will need to return to that same court. There is one exception that applies ONLY in Summit County. If it is a father asking for custody of a child he must go to Domestic Relations Court. All other counties in Ohio use the Juvenile Court for such cases.

Traffic Violations
1. If the charge is a minor misdemeanor for which only a fine is the possible penalty (not time in jail), like jaywalking or speeding, the officer may not arrest you and take you into custody unless you fail to give your name, refuse to sign the citation, or have previously failed to appear in court or pay a fine on a similar offense which resulted in a warrant. Sighing the citation is not an admission of guilt. It is simply proof that the officer gave it to you.
Sex Crimes
This abuse runs the gamut from name calling to simple assaults, unwarranted arrests, stops and searches to violent assaults by citizens or by law enforcement, to murder, rape, and arson. And all delivered to us through the magic of cell phones and YouTube.

Never resist the arrest of another person. You will LOSE and can be arrested and charged with a misdemeanor or a felony.

Wills
When you die, you can leave instructions behind to deal with the distribution of your property and make arrangements for your minor children. Some property will transfer automatically to another person, but some might not and you will need a Last Will and Testament to make it happen. If you have children and are no longer married to the other parent or if you have sole custody, it is important for you to address this situation in your will.
Trusts
Trusts are collections of property (usually money, real estate, and investments, but they can be anything) that are given to the Trust by someone, taken care of by someone, and are used to benefit someone. Frequently the person giving the property to the Trust will also take care of it for his own benefit while he is alive and for someone else's benefit when he is dead. When he can no longer take care of the trust, another person, the new “Trustee”, will take over managing the property. Eventually all of the property will have to be distributed to other people and the Trust terminated. A "Living Trust" is English for the Latin term, "Inter Vivos" and only means that it was made while the person was alive. A Testamentary Trust was made by the Last Will & Testament. If a Trust is revocable, the person making it can end it before it was initially intended to end. If it's irrevocable, he can't.
Power of Attorney
The person signing the Power of Attorney is called the “Principal”. The person who receives the authority under the Power of Attorney is called the “Agent”. We have four different Powers of Attorney. They are filled out by The Principal and signed in front of a Notary Public and notarized by that Notary Public. This is an officer who is commissioned to take oaths and affirmation by the state of Ohio. Banks have them. Most clerks of court have them. Most Attorney are also Notaries Public. They are NOT “Notorios” and you cannot use a “Notorio” for this.
